This chapter is enacted pursuant to Section 1 of Chapter 707
of the Laws of 1981 [Executive Law, § 381(2)]. It shall
provide the method for administration and enforcement of the New York
State Uniform Fire Prevention and Building Code (herein referred to
as the Uniform Code) in the Town of Johnstown and shall establish
powers, duties and responsibilities in connection therewith.
Access to buildings and premises by the Enforcement Officer
to conduct inspections shall be made after reasonable prior notice
has been given to the owner or authorized representative.
Any owner or authorized representative of buildings or premises
affected by the Uniform Code or this chapter may appeal to the New
York State Regional Board of Review the following actions:
A. The determination of the Enforcement Officer of a violation of the
Uniform Code.
B. The application of the Uniform Code where practical difficulties
or unnecessary hardship may result.
The Town Board may adopt such rules and regulations as the Board
deems reasonable to carry out the provisions of this chapter. The
Enforcement Officer may make recommendations to the Town Board to
adopt, amend or appeal such rules and regulations as they may relate
to efficient administration and enforcement of the provisions of the
Uniform Code. Such rules and regulations shall not conflict with the
Uniform Code, this chapter or any other provision of law.
Fees to cover the cost of inspections and the issuance of certificates
of occupancy as provided for by the terms of this chapter shall be
established from time to time by resolution of the Town Board.
