The word "person" as used in this Part shall mean any natural person, partnership, firm, association, organization or corporation. The singular shall include the plural and the masculine shall include the feminine and the neuter.

No person in the Town shall, for commercial purposes or in connection with any commercial enterprise, erect or locate sound amplifying equipment or any device or apparatus within, in front of or on the exterior of the premises owned or occupied by him which, by mechanical electrical means emits loud sound, noise or broadcasts any advertising, so as to annoy passersby on the street or the general public; provided, that, provisions of this Part shall not apply, in time of emergency, to any announcements of any current event of public interest, nor to the use of such equipment in connection with fairs, street fairs and carnivals.

Any person who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of not less than $25 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.
