This Part shall be applicable to any vehicle which is parked in violation of any parking regulation in this Chapter and which is determined to be either registered to an owner who has three or more unresolved and delinquent violations of parking regulations of the Town or which is the subject of an outstanding warrant from any other law enforcement agency.

The Town shall have authority to immobilize any vehicle parked illegally under circumstances described in § 15-1001 of this Part by application or attachment of a vehicle immobilization device, commonly referred to as a "parking boot."

Upon attachment of the immobilization device to a vehicle, the police officer shall affix to the vehicle a notice directing the owner or operator of the vehicle to contact the police department for information on obtaining the release of the vehicle. In addition, within 12 hours after the application of the immobilization device, notice of the fact that such vehicle has been immobilized shall be sent by the Chief of Police to the owner of record of such vehicle. Such notice shall designate the place where the vehicle is immobilized, the reason for its immobilization and the procedure for obtaining its release.

An illegally parked vehicle which has been immobilized as the result of its owner having three or more delinquent parking violations shall be released upon payment in full of any fines and costs relating to such overdue and delinquent violations, plus a processing fee in an amount to be established, from time to time, by resolution of Town Council for the use of the Town of Bloomsburg. An illegally parked vehicle which is immobilized in response to an outstanding warrant from another law enforcement agency shall not be released until such time as said warrant shall be canceled.

The payment of any applicable fines or costs for delinquent violations as a condition for release of an immobilized vehicle shall not operate to relieve the owner or operator of such vehicle from liability for any fine or penalty for the violation of any parking regulation pursuant to which said vehicle was immobilized.
