The purpose of this article is to protect the health, comfort and safety of the citizens of Oconto Falls by restricting the use of tobacco products.
The City of Oconto Falls hereby adopts § 101.123, Wis. Stats., Smoking prohibited, and 2009 Act 12, as amended from time to time.
Any person in charge (defined)[1] of a restaurant, tavern, private club, or retail establishment located in the City may designate an outside area that is a reasonable distance from any entrance to the restaurant, tavern, private club, or retail establishment where customers, employees, or persons associated with the restaurant, tavern, private club, or retail establishment may smoke.

Any person who violates this article shall be subject to a forfeiture of not less than $100 nor more than $250, plus costs, for each violation. If a person in charge violates this article, the City Police must issue a warning notice and the police may not issue a citation for the first violation. For each subsequent violation by a person in charge, the forfeiture, in total, shall be $100, plus costs, for all violations occurring on a single day.
This article shall be effective on July 5, 2010.
