A. Whenever any person shall complain to the Borough or Ordinance Enforcement Officer concerning a dog or dogs engaging in conduct listed in §
113-13A above, the Ordinance Enforcement Officer shall notify the owner of the dog or dogs that a complaint has been received and that the owner must immediately take whatever steps are necessary to terminate such conduct (the "notice").
B. In the event that the §
113-13A conduct continues after the Ordinance Enforcement Officer gives the notice as set forth in Subsection
A of this section, then, upon a complaint concerning the continued violation of §
113-13A, the Ordinance Enforcement Officer shall issue to owner a citation in accordance with §
113-15 of this article.

Any person who violates or permits a violation of this article
shall, upon conviction in a summary proceeding brought before a Magisterial
District Judge under the Pennsylvania Rules of Criminal Procedure,
be guilty of a summary offense and shall be punishable by fine of
not less than $100 not more than $1,000, plus cost of prosecution.
In default of payment thereof, the defendant may be sentenced to imprisonment
for a term not exceeding 90 days. Each day or portion thereof that
such violation continues or is permitted to continue shall constitute
a separate offense and each section of this article that is violated
shall also constitute a separate offense.
