As used in this article, the following terms shall have the
meanings indicated:
PARKS
All areas under the ownership of the Borough of Walnutport
that are or have been made available to the public, for their recreation
and pleasure; whether or not such properties have been leased, rented
or sublet to any organization or group of individuals for the purpose
of developing programs for recreation. The areas defined herein shall
include, but not be limited to the following areas:
A.
WALNUTPORT PLAYGROUNDThat rectangular plot of ground bordered on the west by Lincoln Avenue, on the south by Northern Lehigh School District on the east by Walnutport Shopping Center and on the north by property presently owned by Samuel and Roslyn M. Earnst;
B.
WALNUTPORT CANALThe canal, formerly known as the Lehigh Coal and Navigation Canal, extending along the western border of the Borough of Walnutport;
C.
WAR VETERANS MEMORIAL PLOTThe triangular plot of land situated between Fourth Street and Fifth Street and between Washington Street and Washington Street extension. This article does not apply to any structures or parking areas used by the Diamond Fire Company.
It shall be unlawful for any person at any time to drive or operate any motor-driven vehicle, including but not limited to, automobiles, motorcycles, motor scooters, tractors, trucks or any motor-driven or assisted vehicle upon any of the areas defined in §
300-1 of this article as "Parks" areas. Exceptions to the above prohibition to the use of motor-driven vehicles are:
A. The employment
of motor vehicles on these areas for the maintenance and repair of
the parks;
B. The use
of emergency vehicles responding to emergencies affecting the life
and health of any citizens;
C. Those vehicles
used by the fish and game commission for the servicing of the fish
population of the canal; and
D. The parking
or driving of motor vehicles upon parks areas during "special events,"
which events shall be specifically designated by the Mayor.
The sale, conveyance, consumption, or possession of intoxicating
beverages, including but not limited to, beer, wine, whiskey, or other
alcoholic beverage, is expressly prohibited on or about any of the
above defined park areas, except when specifically authorized in advance
in writing by the Mayor.
Whenever an animal is taken on any of the above defined park
areas, the animal must be under the complete control of the owner
or owners by a leash and must not be permitted to roam or run free
over the parks area. The owner shall remove from the park areas all
fecal matter the animal discharges when on such park areas.

No person shall feed, or cause to feed, in any manner, any and
all wildlife ("wildlife" shall mean animal, fauna, to include fish
and fowl, living in natural, undomesticated state) as may be found
in or upon the Borough park system or property. However, this provision
shall not apply to any wildlife feeding program as may be undertaken
by or prosecuted under the sponsorship of any agency of the federal
government, the Commonwealth of Pennsylvania and/or the Borough of
Walnutport.
No open fires shall be permitted on park areas owned by the
Borough of Walnutport.
It is expressly prohibited to swim at any time in the Walnutport
Canal.
The riding of bicycles on the Walnutport Playground is hereby
expressly forbidden.
Every person using any of the park areas of the Borough of Walnutport
is required to dispose of his or her garbage and trash in the receptacles
provided by the Borough of Walnutport.
The willful destruction or damaging of any property owned by
the Borough of Walnutport located within the above designated parks
areas is expressly forbidden. This prohibition against vandalism extends
to all property either owned or leased by the Borough and includes
but is not limited to, the cutting down of trees on the Walnutport
Canal areas, the damaging of recreational additions such as park benches,
baseball dugouts, refreshment stands, pavilions, monuments, flag poles,
swings, merry-go-rounds, sliding boards, seesaws, boats and locks.
Any person who shall violate any provision of this article shall upon conviction thereof, be sentenced to pay a fine not exceeding $600 together with costs of prosecution, or to undergo imprisonment for a term not to exceed 30 days; provided, however that each violation of any provisions of this article shall be deemed a separate offense. Further, if a person or persons is charged with and convicted of a violation of this article and it relates to §
300-10, said person or persons shall make restitution to the Borough.
The remedies provided herein for the enforcement of this article
or of any remedy provided by law, shall not be deemed mutually exclusive;
rather, they may be employed simultaneously or consecutively, at the
option of the Borough Council.

It shall be unlawful for any person to engage in any type of
camping, whatsoever, including remaining overnight, the erection of
tents or other shelters, sleeping overnight with or without a tent,
using sleeping equipment, a vehicle, or a trailer camper, in or on
any public Borough park or in or on any Borough property.
Any person, organization or entity who wishes to camp on Borough
property may make a request to Borough Council at a public meeting
at least 30 days prior to the proposed activity. If Borough Council,
by majority vote, deems that it is appropriate to allow camping for
the special event, the Borough may grant a permit, upon assurance
from the requesting entity, that it has appropriate insurance and
any and all other necessary documentation to insure an orderly event.
A. The fee for a special event permit shall be established pursuant
to resolution; said fee shall include costs sufficient to cover any
cleanup, where applicable.
Any person, group or entity violating any of the provisions
of this article shall, upon conviction thereof, pay a penalty of not
less than $300, nor more than $1,000, and upon default of payment
of the penalty and costs of prosecution, the person or persons convicted
may be committed to the Northampton County Prison for a period not
to exceed 30 days.
