The Township shall provide trash collection service for single- or two-family dwelling properties having independent outside access, provided that the trash is placed for collection on the curbline of a public street. "Public street," as used herein, shall mean a street dedicated to and accepted by the state, the county or the Township as and for a public highway and open to the public for such use.
Garbage and refuse will be collected from the various portions of the Township in accordance with a schedule which the Board of Commissioners shall approve. Collection shall commence at 7:00 a.m., except from the first Monday in June through the Friday before Labor Day, when collections shall commence at 6:30 a.m. Rubbish containers must be placed at curbside before the scheduled time but no more than 12 hours prior thereto. Refuse containers must be removed from curbside not more than 12 hours after collection. Failure to comply shall constitute a public nuisance, as provided for in another section of this Code.[1]

A. 
Containers for trash collected by the Township shall be of galvanized metal or plastic, capable of withstanding water and freezing temperatures. All containers shall be closed with lids that are removable and shall have a maximum capacity of 50 gallons. All containers must have usable rigid handles that may or may not pivot, attached to the outside of the container. All containers must be of a tapered design with the top being wider than the bottom. All containers shall weigh less than 10 pounds empty. The combined weight of the container and the trash may not exceed 50 pounds.

B. 
Fifty-five-gallon drums are not permitted. No cardboard drums or boxes shall be acceptable as trash containers.
C. 
Plastic or vinyl bags used as containers are permitted for only nonputrescible trash. Combined maximum weight of plastic or vinyl bags and trash may not exceed 20 pounds per bag.
D. 
All ashes for trash pickup shall be placed in plastic bags.
E. 
The Township shall not be responsible for containers damaged during the process of trash collection.
Appliances such as refrigerators, washing machines, clothes dryers, window air conditioners, hot water heaters and other major home appliances; bulky items such as furniture, bed springs or mattresses; other noncombustible items such as metal items; computer components, including CPUs, keyboards, monitors and printers; televisions, stereos, radios, video equipment, including VCRs and DVD players; and any other electronic equipment shall not be placed for collection with other "acceptable municipal waste," as defined in § 279-6 hereof, but shall be collected by the Township by the obtaining of a permit from the Department of Code Enforcement of the Township and the payment of a fee in accordance with the schedule adopted by the Board of Commissioners and set forth in Chapter 140, Fees, Rates and Permits, of the Township Code.
A. 
The Director of the Public Works Department is hereby authorized to adopt regulations as to the manner, time and acceptable method of the placement of refuse for collection.
B. 
No Township employee is permitted to enter any building to remove waste for collection or to receive any tips.
C. 
Waste shall be placed for collection on a regular basis and not accumulated. Containers shall not be overfilled so as to allow them to be handled without spilling any refuse.
D. 
Only "acceptable municipal waste" shall be collected, which term shall mean any garbage, refuse or other material, including solid, liquid, semisolid or contained gaseous materials, resulting from residential uses within the Township. No "unacceptable waste" shall be collected or mixed with any "acceptable municipal waste."
E. 
"Unacceptable waste" shall consist of any of the following materials:
(1) 
Explosives or radioactive materials;
(2) 
Pathological and biological waste, sludges, cesspool or other human waste, human and animal remains, any animal wastes or manure in excess of five pounds in weight;
(3) 
Motor vehicles or major components thereof;
(4) 
Contained gaseous materials which may pose a risk to Township employees or the public in the handling or disposal thereof;
(5) 
Any other "hazardous waste," as that term is defined in the Solid Waste Management Act, Act of July 7, 1980, P.L. 380, No. 97, as amended, 35 P.S. § 6018.101 et seq., or any succeeding legislation as may be adopted by the General Assembly of the Commonwealth of Pennsylvania or as may be defined in any applicable federal law or regulation;
(6) 
Construction and demolition debris, ashes, incinerator residue, earth or stones;
(7) 
Medical, dental or other "red bag" waste;
(8) 
Refrigerators, washing machines, clothes dryers, window air conditioners, hot water heaters and other major home appliances or other bulky objects which are collectible under the provisions of § 279-5 hereof;
(9) 
All recyclable materials, including but not limited to "aluminum beverage cans," "bimetal food containers," "clean and uncontaminated newspaper," "glass," "grass clippings," "leaf waste," and "tree or shrubbery branches," as those words and phrases are defined in Articles IV and V of this chapter, shall not be placed with any other waste but shall be placed for collection in accordance with those applicable articles;
(10) 
Any household garbage or other putrescible material which has not been drained and wrapped to delay decomposition and to prevent insect infestation of such materials; and
(11) 
Computer components, including CPUs, keyboards, monitors and printers; televisions, stereos, radios, video equipment, including VCRs and DVD players; and any other electronic equipment which shall be collectible under the provisions of § 279-5 hereof;
F. 
Any violation of the provisions of these regulations may, in addition to the penalties hereafter provided, be the basis for the refusal of the Township to collect waste from the persons and property involved.
G. 
The duty to comply with these regulations shall be and is hereby imposed upon the owner or owners of record of any property ("record owner"), as reflected by the tax duplicate prepared by the Board of Assessment of Montgomery County, as updated from time to time. In the event that the record owner is a lessor of the property, it shall be the duty of such lessor to inform the lessee of the various requirements of these regulations, as amended from time to time, by an appropriate provision in the lease agreement, by posting a copy of this article in the property, or otherwise in any fashion reasonably designed to provide actual notice of such regulations, and it shall be the duty of the record owner as lessor to cause the lessee to conform to the requirements of these regulations.
A. 
Any person or persons who shall violate the provisions of § 279-2, Times of collection, shall receive an official written warning of noncompliance for the first and second offense. Thereafter, all such violations shall be subject to the penalties hereinafter provided.
B. 
Except as hereinbefore provided, any person or persons who shall violate any provisions of this article shall, upon summary conviction before a magisterial district judge, be sentenced to pay a fine of not less than $100 nor more than $1,000 and costs of prosecution for each and every offense or, in default of payment of such fine and costs, to undergo imprisonment for not more than 10 days for each violation.
