The local school board, any private entity, corporation and/or
individual may hire police officers for extra-duty assignments. Applications
describing the specific nature of the services being requested shall
be submitted to the Chief of Police who shall determine the propriety
of such request. Extra-duty assignments that are approved shall be
made available to members of the Police Department who may wish to
engage in such activities.
A.Â
The local school board, any private entity, corporation and/or individual
requesting police officers for extra-duty assignments pursuant to
this article shall be responsible for the cost of such services as
set forth in this section.
B.Â
The local school board, any private entity, corporation and/or individual
requesting police officers for extra-duty assignments shall make application
to the Chief of Police stating, among other things, the anticipated
time in which such extra-duty assignment services will be required.
The Chief of Police will thereafter inform the requesting party as
to the appropriate amount to be placed in a special escrow account.
The local school board, any private entity, corporation and/or individual
requesting such services, within three days of the proposed commencement
of such services, shall tender this escrow amount to the Chief of
Police, who will remit same to the Chief Financial Officer for deposit
into the special escrow account.
C.Â
No extra-duty assignment services shall commence without the posting
of the escrow as herein required, nor shall extra-duty assignment
services continue if the funds escrowed are insufficient to cover
the costs of the continuation of such services. The escrow balance
shall at all times be sufficient to pay for extra-duty assignments
before said services are rendered and no services shall be rendered
unless prepaid. No escrow shall be required for emergency services
and/or services where the scope of the work, in the judgment of the
Chief of Police, is of a limited nature.
D.Â
The Chief of Police is responsible for all contacts with the local
school board, any private entity, corporation and/or individual requesting
extra-duty assignment services and for the status of escrow balances.
The recipient of services will receive a statement of charges within
10 days of the cessation of such services.
A.Â
Hourly rates for extra-duty assignments shall be established annually
by resolution of the Borough Council. The rate charged shall include,
but not be limited to, the hourly rate to be received by police personnel
performing such services, a fee for the use of Borough-owned equipment,
and any such sum as may be required by the Borough to cover the administrative
cost of providing such services.
B.Â
The minimum charge for any extra-duty assignment service shall be
three hours per officer scheduled.
C.Â
The local school board, any private entity, corporation and/or individual wishing to cancel an extra-duty assignments after having scheduled police officer(s) shall notify the Oaklyn Police Department at least two hours prior to scheduled start time to cancel the scheduled officer(s). Failure to cancel within this time period shall be required to tender to the Borough payment of the minimum charge for any extra-duty assignment service as set forth in § 35-13B of this chapter.
The Chief Financial Officer shall pay police personnel performing
extra-duty assignments at the established hourly rate for extra-duty
assignments, less regular payroll deductions. Payment to police personnel
shall be made during the next regular pay period following the performance
of any extra-duty assignment.
The performance of any extra-duty assignment is contingent upon
the Borough's ability to provide the necessary manpower through
the employment of off-duty police personnel. In the event that the
Police Department fails to perform or complete any extra-duty assignment,
the Borough's liability shall be limited to refunding any fee
or portion thereof received as payment for such services.
