Creation of position. There is hereby created the position of school
crossing guard. The total authorized number of school crossing guards
shall be determined annually by the Township Committee considering,
among other factors, the number of intersections requiring guards,
the number of personnel required to meet the duties of a school crossing
guard, and budgetary considerations.
The governing body of the Township shall appoint school crossing
guards for terms not exceeding one year upon the recommendation of
the Chief of Police.
A school crossing guard may be a member of the Police Department
and his or her powers and duties as a school crossing guard shall
cease at the expiration of the term for which he or she was appointed.
He or she shall not have the right to bear firearms or the power to
arrest unless the crossing guard is also a member of the Police Department.
Before being assigned to any post, a school crossing guard shall
be provided with a uniform which shall identify his or her function
and which shall be distinct from the uniform of a member of the regular
Police Department. Such uniform shall include, but need not be limited
to, a safety vest, a hat and breast and hat badges which shall bear
an identification number and the name of the municipality. A police
officer appointed or assigned as a crossing guard shall wear such
uniform as directed by the Chief of Police. All uniforms and badges
shall be the property of Chesterfield Township and returned upon break
in service with the municipality.
Training. Every school crossing guard shall be trained for the proper
performance of his or her duties and responsibilities. Such training
shall consist of a minimum of two hours of classroom instruction which
shall include information on methods of traffic control and the duties
and responsibilities of school crossing guards and a minimum of 20
hours of field training in which the trainee shall be supervised by
an experienced school crossing guard or a regular police officer.
This training requirement may be waived by the Chief of Police for
a school crossing guard who is also a police officer. Training shall
be coordinated through the Police Department.
Stations; time periods. The Chief of Police, or his or her designee,
shall have the right to position school crossing guards on any street
or highway within the municipality; provided, however, that such guards
may be stationed only when it is necessary to control or direct vehicular
or pedestrian traffic during those time periods of a school day when
it is necessary to control traffic or during any special event involving
pedestrian crossings whenever it is deemed to be in the interest of
public safety.
Pursuant to the authority set forth in Titles 39 and 40A of the state
statutes, school crossing guards shall have the authority to direct
operators of motor vehicles approaching school crossings. This shall
include the authority to direct operators of motor vehicles to stop
their vehicles not less than 10 feet nor more than 30 feet from the
school crossing and to remain stopped until the school crossing guard
directs the operator to proceed.
Each school crossing guard shall be paid per shift for actual number
of shifts worked, said rate to be determined annually by the Township
Committee via resolution, but shall be no less than $10 and no more
than $30 per shift.
Crossing guards shall not be entitled to holiday pay, vacation or
sick time, longevity pay, health and pension benefits, unless required
by state law as the same may be amended from time to time.
