A. Location. The provisions of this article shall apply to the land
located in the Township of Bethlehem known as the Roerig Farm and
identified as of Block 33, Lot 40.01, consisting of approximately
40 plus or minus acres (hereinafter "the property"). Hunting may be
permitted on the property in strict compliance with all applicable
laws and the provisions of this article. The provisions of this article
shall serve as a supplement to all applicable federal and state hunting/game
laws and regulations. In the event the provisions of this article
are more restrictive than said federal and/or state law, this article
shall control. In event any provision of this article is inconsistent
with said federal and/or state law, then the applicable federal and/or
state law shall apply.
B. Targeted game. Targeted game shall be limited to such game as permitted
by the New Jersey fish and game laws.
C. Season. The hunting season shall be followed in accordance with New
Jersey fish and game laws and regulations for each game hunted. Hunting
shall not be allowed on any Township property unless authorized under
this Code. No hunting shall be allowed on Sundays.
D. Permitted hunting hours.
(1) Hunters who are issued a permit hereunder shall be deemed "authorized
hunters" and may hunt at the property during the specified hours as
set forth in the New Jersey fish and game laws.
(2) Authorized hunters shall not be allowed on the property for more
than 60 minutes prior to the legal shooting time. Authorized hunters
shall not be allowed on the property for more than 60 minutes after
the legal shooting time. Authorized hunters may remain on the property
for more than 60 minutes after the legal shooting time in order to
track a wounded animal or locate a missing person; provided, however,
that said hunter shall notify a park ranger by cellular phone or in
person or leave a note on his or her vehicle.
E. Compliance with New Jersey Green Acres and New Jersey Environmental
Infrastructure Finance Program regulations. The property is subject
to the New Jersey Green Acres regulations of the New Jersey Department
of Environmental Protection (N.J.A.C. 7:36 et seq.) and New Jersey
Environmental Infrastructure Finance Program regulations (P.L. 1985,
c. 329, N.J.S.A. 58:11B-1 et seq. and P.L. 1992, c. 88.) The public
shall be afforded reasonable access to the property in accordance
with the New Jersey Green Acres regulations and New Jersey Environmental
Infrastructure Finance Program regulations.
No hunting is allowed on the property unless a permit is issued
by the Township.
A. Requirements for obtaining and displaying initial and subsequent
permits:
(1) One permit may be issued per hunting season to a hunting club that
successfully bids for a license from the Township in accordance with
the New Jersey Local Lands and Buildings Law (N.J.S.A. 40A:12-1 et
seq.), the New Jersey Local Public Contracts Law (N.J.S.A. 40A:11-1
et seq.), the New Jersey Green Acre regulations (N.J.A.C. 7:30 et
seq.), and the provisions of this article.
(2) Said permit shall be issued to the hunting club upon execution of
an agreement with the Township or with a designated party so authorized
by the Township by resolution. Any and all proposed hunting agreements
shall be subject to the review and approval of the Township governing
body.
(3) Only those individuals who are members in good standing of the hunting
club shall be allowed to hunt at the property.
(4) Only persons who hold a valid New Jersey hunting permit shall be
authorized to hunt at the property.
(5) Any person convicted of a crime or of a disorderly persons offense
in any state or federal court shall not be permitted to hunt at the
property.
(6) Authorized hunters shall be required to sign a release and indemnification
in favor of the Township, subject to the review and approval of the
Township Attorney, prior to the issuance of a permit.
(7) Any permit issued by the Township shall be nontransferable. No guests
are permitted.
(8) Authorized hunters shall carry a copy of said permit and a valid
New Jersey hunting license.
(9) Authorized hunters shall display a placard, issued by the Township,
on the dashboard of the hunter's parked vehicle. The Township
shall have the right to tow any vehicle parked on Township property
that does not display a placard.
B. Application process to obtain a permit for each year's hunting
season. Applications are to be made by the hunting club organization
on behalf of their members by filing a written request with the Township
Municipal Clerk's office and by providing any and all information
and documentation required under this article.
C. Insurance and indemnification. The hunting club shall maintain commercial
liability insurance of at least $2,000,000 as required under the hunting
agreement. The policy shall be obtained from a company with a rating
of "A" or better, and the Township shall be named as an additional
insured and certificate holder on the policy. The hunting club shall
indemnify, defend and hold harmless the Township from and against
all claims, demands, suits and liability in accordance with any and
all hunting conducted on Township property.
A. The Township shall allow such hunting methods to the extent set forth
in the New Jersey fish and game laws.
B. Field dressing of harvested animals is prohibited in areas near roads
and trails.
C. Each permit holder is limited to the maximum number for each species
as allowed by the New Jersey fish and game laws.
A. The hunting club shall prepare and file with the Township a written
report after each season within 30 days thereof and said report shall
list all animals harvested at the property.
B. Authorized hunters are responsible for observing the property's
boundaries and for obeying all posted signs.
C. Authorized hunters are required to report any violation of federal
and/or state game laws and any violation of the provisions of this
article to the New Jersey State Police and the Township governing
body.
D. Authorized hunters shall comply with the provisions of this article
without exception. Failure to do so may result in the revocation of
any permit issued by the Township.
