A certain document, three copies of which are on file in the office of the Secretary of the Township of Loyalsock, being marked and designated as the International Residential Code, 2009 edition, to include Sections AE501 to AE503 and AE601 to AE605 of Appendix E and Appendix G as published by the International Code Council and regulated in the Pennsylvania Uniform Construction Code, Section 403.21 (a) and (b), and is hereby adopted as the Residential Code of the Township of Loyalsock, in the State of Pennsylvania, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupancy and use and the demolition of such structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Residential Code and/or the Pennsylvania Uniform Construction Code on file in the office of the Township of Loyalsock are hereby referred to, adopted and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in § 100-34 of this article.
The following sections are hereby added to the code by approval of Section 403.2 of the Pennsylvania Uniform Construction Code:
A. 
Section R101.1, Title, is amended to insert "the Township of Loyalsock."
B. 
Section R105.5, Expiration, is amended by changing the text to the following: "The construction of dwellings and additions, including garages, patios, porches, or any other associated residential construction shall be limited to one year from the issuance date."
C. 
Section R105 shall be amended by adding a new subsection:
R105.10 Obtaining permits. Permits must be obtained and paid in full within 14 days of the issuance date. Failure to obtain and pay in full within the time frame allotted will make this permit null and void. Reissuance of said permit will be based on late fee charges.
D. 
Section R113, Violations shall be amended by adding a new subsection to read as follows:
R113.5. Any person who shall violate provisions of this code or shall fail to comply with any of Section R113 or R114 shall be punishable by a fine not less than $100 nor more than $2,000 plus cost, and, in default of payment of such fine and costs, to imprisonment not to exceed 30 days. Each day's continuance shall constitute a separate offense.
E. 
Section R309.1, Floor surface, shall be amended to read as follows:
R309.1 Floor surface. Garage and carport floor surfaces shall be of approved noncombustible material. That area of the floor used for parking of automobiles or other vehicles shall be a minimum of four inches lower than the dwelling unit when the garage is attached to the dwelling. The garage floor shall slope to facilitate the movement of liquids toward the main vehicle entry doorway.
F. 
In Section R314, Smoke Alarms, Section R314.3 shall be amended by adding an item number 4 to the section to read as follows: "In every attached garage."
G. 
Section R322, Flood-Resistant Construction, shall be amended to add a new subsection:
322.3.7 Issuance of a building permit in a flood hazard area. The Building Code Official shall issue a building permit only after it has been determined that:

The proposed work to be undertaken will be in conformance with requirements of this and all other applicable codes and ordinances.
2.
A code official shall review the application for the permit to determine if all other necessary government permits required by state and federal laws have been obtained, such as those required by the Pennsylvania Sewage Facilities Act, the Pennsylvania Dam Safety and Encroachment Act, the Pennsylvania Clean Streams Act and the U.S. Clean Water Act. No permit shall be issued until this determination has been made.

No encroachment, alteration or improvement of any kind shall be made to any watercourse until all adjacent municipalities which may be affected by such action have been notified by the Township and until all required permits or approvals have been first obtained from the Department of Environment Protection, Bureau of Dams, Waterways and Wetlands.
4.
The Federal Insurance Administration and Pennsylvania Department of Community and Economic Development shall be notified by the Township prior to any alteration or relocation of any watercourse.
H. 
Section R322, Flood-Resistant Construction, shall be amended to add a new subsection:
R322.3.8 Elevation required. All buildings or structures erected within the one-hundred-year floodplan shall be elevated so that the lowest floor is located one foot six inches above the base flood elevation.
I. 
Section R403, Footings, shall be amended to add a new subsection:
R403.1.1.1 Formed footers. All footings for foundations systems where it is for a basement or crawl space shall be formed on both sides to ensure adequate size and depth.
J. 
Section R408, Under-Floor Space, shall be amended to add a new subsection:
R408.2.1 Maximum height. Crawl space area from bottom of joists to grade inside crawl space area shall not exceed four feet zero inches in height.
K. 
Section M2201, Oil Tanks, shall be amended to add a new subsection:
M2201.2.3 Oil tank enclosure. Any aboveground oil tank must be screened in a manner to serve as a sight barrier from neighboring properties, streets and roads. Said screening may be a wooden wall, solid fencing, shrubs or other material approved by the Building Code Official. Said barrier must be maintained at all times after installation of the aboveground tank.
L. 
Section P2603.6.1, Sewer depth, shall be amended to insert at two locations: minimum of "36" inches below finished grade and minimum of "36" inches below grade.
M. 
Section P3002.2, Building sewer, shall be amended to add a new subsection:
3002.2.1 Building sewer installation. All building sewers (laterals) are required to be installed per the Loyalsock Township sanitary sewer regulations and inspected by the Sewer Department.
Nothing in this article or in the Residential Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 100-34 of this article, or shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
The Secretary is hereby ordered and directed to cause this article to be published.
