Town of Madison, ME Violations and Penalties; Appeals

Any violation of this chapter by an applicant control person, manager or operator of any such establishment regulated by this chapter shall be subject to a minimum fine of $500 for each offense. In addition, the CEO may suspend or revoke the permit for any establishment offering nude entertainment in violation of this chapter, or in violation of conditions contained in the permit.

Any violation of this chapter by a person other than an applicant control person, manager or operator of a premises regulated by this chapter shall be punished by a fine of not less than $500 for the first offense, and not less than $1,000 for the second and subsequent offenses.

Attorneys' fees and costs. If a court determines that an applicant control person, manager or operator or any other person has violated this chapter, the violator(s) shall pay the Town's attorneys' fees, court costs and out-of-pocket expenses incurred by the Town in any enforcement action undertaken to correct a violation. Violators shall be jointly and severally liable for such fees and costs as a court may award pursuant to this subsection.

Any aggrieved party wishing to appeal the CEO's denial, suspension or revocation of a permit shall have 30 days from the date of the CEO's written denial, suspension or revocation to appeal to the Board of Appeals in accordance with the procedures set forth in Chapter 7 of the Town of Madison Code of Chapters.
