As used in this article, the following terms shall have the meanings indicated:
LEAVES
Those materials naturally formed from trees and bushes that are suitable for composting and/or mulching purposes.
PERSONS
All residential, commercial and institutional property owners and/or occupants within the Borough of Wallington.
SOLID WASTE
Includes all solid waste, garbage, refuse, trash, etc., with the exception of recyclable materials as defined by Article II of this chapter, usually disposed of under the municipal garbage contract and normally placed for curbside pickup by residents of the Borough of Wallington for usual collection at regular intervals by the contractor.
Upon the adoption of this article and beginning October 1 through November 30 and continuing during that period each and every year thereafter, as promulgated by regulations issued by the Superintendent of the Department of Public Works of the Borough of Wallington in accordance with the terms hereof, it shall be mandatory for all persons who accumulate leaves to separate the same from municipal solid waste and recyclable materials and to place said leaves at curbside for collection in accordance with this article at a scheduled interval particular to that specific geographical area of the Borough of Wallington as prescribed in the aforementioned regulations to be promulgated.
All persons shall accomplish those obligations contained in the previous section in strict conformity with the following regulations:
A. 
The use of any and all plastic container bags in conjunction with actual leaf collection by the Borough of Wallington is prohibited.
B. 
All leaves must be separated from municipal solid waste and recyclable materials and, as a consequence, are prohibited from inclusion in the regular curbside collection of municipal solid waste and/or recyclable materials.

Strict adherence to all requirements contained herein or regulations to be promulgated notwithstanding, any person may choose to compost and/or mulch his particular leaves on site for his personal horticultural benefit, provided that such activities are of no adverse consequence to health and safety codes currently governing or to be promulgated to govern such activity and that such alternate means of disposal are accomplished at no cost to the Borough of Wallington.
B. 
At the option and expense of persons required to separate leaves from municipal solid waste, said leaves may be brought to the leaf composting facility under contract with the Borough of Wallington.
This article shall be enforced by the Borough Clerk, by the Superintendent of the Department of Public Works, by the Board of Health, Departments of Police and Public Works and any such other employees or departments of the Borough of Wallington as designated, in writing, by the Mayor and Council.

Any person who violates any provision of this article as well as regulations issued pursuant thereto shall, upon conviction thereof, be punishable as provided in Chapter 1, Article II, General Penalty, of the Code of the Borough of Wallington, with each violation constituting a distinct and separate offense.
