§ 286-1 Statement of regulatory purposes.

This chapter is adopted pursuant to the authority granted in N.J.S.A. 40:48-2 et seq. The purposes of this chapter are as follows:
A. 
To establish a residential parking program in those areas of the Borough in order to facilitate and make more convenient parking within the Borough of Wallington for those persons who reside within the said municipality.
B. 
To address a critical parking shortage in those specific areas and/or districts designated by the Borough of Wallington as being in need of a residential parking program.
C. 
To control and/or monitor on-street parking in the Borough of Wallington so that the persons regulated under this chapter may do so in a safe, efficient and nonhazardous manner.

§ 286-2 Resident parking program.

A. 
A resident parking program shall be instituted as follows. During certain hours, the streets of the Borough of Wallington will be designated "Resident Parking Only."
B. 
Rules and regulations. The following rules and regulations shall apply to the Borough of Wallington Resident Permit Parking Program:
(1) 
A resident parking permit of a design specified by the Chief of Police of the Borough of Wallington will be issued to residents of Wallington who own a motor vehicle with a gross weight of no more than 6,000 pounds or no more than two axles or no more than four wheels touching the ground on any street in the Borough of Wallington. There will be no permits issued to those vehicles which are registered as or described as being trailers. Excluded from this provision are any trucks which are in the process of any delivery or pickups and any truck(s) utilized by utility companies in the State of New Jersey or their entities or any trucks that are already covered by other ordinances.
(2) 
Proof of residency of the owner of a vehicle must be presented when applying for a permit. The following is acceptable proof of residency: a copy of a valid New Jersey driver's license reflecting the vehicle owner's residency within the Borough of Wallington; a copy of a valid New Jersey motor vehicle registration for the vehicle for which the permit is sought, showing the vehicle owner's address in the Borough of Wallington; and one additional item reflecting the vehicle owner's residency such as a utility bill. A post office box number will not be deemed proof of residency in order to receive a resident parking permit. In the case of a vehicle claimed to be leased and used by a Wallington resident, a copy of a valid motor vehicle registration and a copy of the automobile lease shall be presented to the registering agency of the Borough of Wallington showing the Wallington resident has control over the vehicle. In the case of a vehicle which is registered to a company or corporation, a copy of a valid motor vehicle registration and a letter from the registered owner showing that the Wallington resident has control of this vehicle after business hours shall be presented to the registering agency of the Borough of Wallington along with the above-listed proof-of-residency items.
(3) 
The resident sticker is to be placed on the rear window of the driver's side, in the lower left-hand corner of the registered vehicle.
(4) 
Only one resident parking sticker shall be issued for a commercial vehicle (a vehicle with commercial plates) per household.

§ 286-3 Visitor permits.

There shall be a temporary visitor permit issued to any resident who applies in person to the Wallington Police Department Record Bureau during the following hours: Monday to Friday 9:00 a.m. to 4:00 p.m. and Saturday from 9:00 a.m. to 12:00 noon. The visitor's permit may be used for a period of seven days.

§ 286-4 Required information.

Any person requesting a resident or temporary visitor's parking permit will be required to submit a vehicle identification number and license plate number of the vehicle, driver's license number and such other information as may be required by the Police Department of the Borough of Wallington.

§ 286-5 Term of permits. [1]

Resident parking permits will be valid for a period of three years from the month of issuance. Any vehicle bearing an expired permit and parked on a street where signs have been erected stating "Permit Parking Only" shall be subject to the same penalty as a vehicle parking on the street without a resident parking permit program sticker as set forth herein.

§ 286-6 Parking without permit or expired permit; violations and penalties.

Any vehicle parked on a street without a valid resident parking permit or an expired resident parking permit shall be subject to the following sanctions: Unless another penalty is expressly provided by N.J.S.A. 39:4-203, every person convicted of a violation of this section or any supplement thereto shall be liable to a penalty of $50 or imprisonment for a term not to exceed 15 days, or both, for each offense.

§ 286-7 Unauthorized use, duplication or sale of resident parking sticker; violations and penalties.

A. 
The unauthorized making, duplicating, selling, lending or giving of any resident parking sticker is hereby prohibited. This provision shall include, but is not limited to, any unauthorized duplication or use of a Borough of Wallington Resident Parking Sticker.
B. 
Any person violating this provision of this chapter shall be subject to those penalties set forth in Chapter 1, Article II, General Penalty, of the Code of the Borough of Wallington.[1]

§ 286-8 Further rules and regulations.

The Police Department of the Borough of Wallington shall have the authority to formulate or promulgate rules and regulations pertaining to this chapter, subject to the veto of the Borough Council; and the Police Department of the Borough of Wallington shall be entitled, in its discretion, to verify any information appropriate to the enforcement of this chapter. The Police Department of the Borough of Wallington shall have the power to issue summonses for violation of this chapter.

§ 286-9 Enforcement.

Enforcement of this chapter and any further rules and regulations as may be promulgated from time to time shall be under the jurisdiction of either the Police Department of the Borough of Wallington and/or the Chief of Police of the Borough of Wallington, as determined by the Borough Administrator of the Borough of Wallington.

§ 286-10 All-night parking. [1]

No person shall park a vehicle all night on the streets of the Borough in violation of § 307-17.1 of the Code without the required resident parking permit.
