As used in this article, the following terms shall have the
meanings indicated:
BUSINESS OR COMMERCIAL ESTABLISHMENT
Any retail, manufacturing, wholesale, institutional, governmental
or other nonresidential establishment at which garbage or trash may
be generated.
BUSINESS OR COMMERCIAL TRASH
Any waste accumulation which is generated and which is usually
attendant to the operation of any nonresidential establishment, such
as, but not limited to, the operation of stores, offices, commercial
ventures, retail establishments or other similar operations.
All owners of said business and commercial establishments in
which garbage or trash may be generated from food which is purchased
for off-premises consumption shall keep in the vicinity of the entrance
to such premises a sufficient number of adequate refuse containers
for refuse generated from food purchase for off-premises consumption.
No person shall place, throw or deposit any waste material upon
the outside premises or parking area of any business or commercial
establishment or on any street, alley or adjoining property or in
the vicinity of a business or commercial establishment except in adequate
receptacles provided for that purpose, nor shall the owner of such
business or commercial establishment permit such conduct.
A proprietor of a business or commercial establishment shall
cause to be removed from said receptacles all garbage and refuse which
may accumulate therein on a daily basis. No garbage and refuse shall,
while in such containers, be stored in such a manner as to create
a nuisance. All containers shall be watertight metal or plastic receptacles
of thirty-gallon capacity or less and shall be kept clean and in good
repair.

Any person or persons who shall violate or fail to comply with any of the provisions of this article, upon conviction thereof, shall be punishable as provided in Chapter
1, Article
II, General Penalty, of the Code of the Borough of Wallington.
