This Article 3 establishes minimum regulations governing the design, construction, quality of materials, erection, installation, alteration, enlargement, repair, demolition, removal, maintenance and use of one- and two-family dwellings. It provides for the issuance of permits, collection of fees, making of inspections, and provides penalties for violations of the various codes and regulations adopted as part of this Chapter 14.
The International Code Council, Inc., 2015 Edition of the International Residential Code for One- and Two-Family Dwellings (the "Residential Building Code") is hereby adopted by reference and is hereby made a part of this Article 3 with the same force and effect as if fully set forth herein, except, however, those exceptions, insertions and additions described in Section 14-3-3 of this Code. The Residential Building Code, together with the International Building Code and International Existing Building Code set forth in Article 2 of this Chapter 14, are collectively referred to as the "Building Code" for the Village.
The following items are the additions, insertions and changes to the International Residential Code:
Section 101.1 Title.
Delete all and insert "These provisions shall be known as the Residential Code for One- and Two- Family Dwellings of the Village of Lincolnwood and shall be cited as such and will be referred to herein as 'this code.' The Village of Lincolnwood shall be inferred whenever the term 'Village' is used in this code."
Section 101.2 Scope.
Delete all and insert "The provisions of this code shall apply to the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, removal and demolition of detached one- and two-family dwellings and townhouses with a separate means of egress and their accessory."
Section 101.2 Scope. Exception:
Delete all and insert "The following shall be permitted to be constructed in accordance with this code where provided with a residential fire sprinkler system in accordance with NFPA 13D
"1.
Live/work units located in townhouses and complying with the requirements of Section 419 of the International Building Code.
"2.
Owner-occupied lodging houses with five or fewer guestrooms in accordance with NFPA 13D.
"3.
A care facility with five or fewer persons receiving custodial care within a dwelling unit.
"4.
A care facility with five or fewer persons receiving medical care within a dwelling unit.
"5.
A care facility for five or fewer persons receiving care that are within a single-family dwelling."
Section 102.4.1 Conflicts.
Delete all and insert "Where conflicts occur between this code as well as the Illinois Plumbing Code, most current edition, the 2014 National Electric Code NFPA 70 and the Illinois Energy Conservation Code, most current edition and other referenced codes and standards, this code as well as the Illinois Plumbing Code, most current edition, the 2014 National Electric Code NFPA 70 and the Illinois Energy Conservation Code shall apply."
Section 102.4.2 Provisions in referenced codes and standards.
Delete all and insert "Where the extent of the reference to a referenced code or standard includes subject matter that is within the scope of this code, the provisions of this code, as applicable, shall take precedence over the provisions in the referenced code or standard."
Add (new section) Exceptions: and insert lines (1 through 3) as follows:
"1.
All references to Part VII Plumbing Chapters 29 through 33 throughout this code shall be deleted and referenced back to the Illinois Plumbing Code, most current edition.
"2.
All references to Part IV Energy Efficiency Chapter 11 throughout this code shall be deleted and referenced back to the Illinois Energy Conservation Code, most current edition.
"3.
All references to Part VIII Electrical Chapters 34 through 43 throughout this code shall be deleted and referenced back to the 2014 National Electric Code NFPA 70."
Section 103.1 Creation of enforcement agency.
Delete all and insert "The Division of Building Safety, as part of the Community Development Department, is hereby created, and the official in charge shall be known as the 'Building Official.'"
Add (new section) 105.1.1 Failure to pick up an approved permit within six months.
Insert "Failure to pick up an approved permit within six months from time of initial permit submittal where contact was made to the applicant and/or owner to pay for, pick up and set up appropriate inspections, shall be deemed 'Work performed prior to issuance of permit' and subject to double the standard permit fees according to the Village's Annual Fee Resolution,[1] and Section 14-14-6 of the Village Code."
Section 105.2 Work exempt from permit. Building:
Delete all and insert:
"1.
Painting, papering, tiling not in showers or bathtubs, carpeting, finish flooring, and other similar finish work but not including cabinetry and countertops where plumbing exists.
"2.
Swings and other playground equipment."
Section 105.2 Work exempt from permit. Electrical:
Delete all and insert:
"1.
Listed cord-and-plug connected temporary decorative lighting.
"2.
Reinstallation of attachment plug receptacles but not the outlets therefor.
"3.
Replacement of branch circuit overcurrent devices of the required capacity in the same location.
"4.
Minor repair work, including the replacement of lamps or the connection of approved portable electrical equipment to approved permanently installed receptacles."
Section 105.3 Application for permit.
Delete all and insert "To obtain a permit, the applicant shall first file an application therefor in writing on a form furnished by the Division of Building Safety for that purpose. Such application shall:
"1.
Identify and describe the work to be covered by the permit for which application is made.
"2.
Describe the land on which the proposed work is to be done by legal description, street address or similar description that will readily identify and definitely locate the proposed building or work.
"3.
Indicate the use and occupancy for which the proposed work is intended.
"4.
Be accompanied by construction documents and other information as required in Section R106.1.
"5.
State the valuation of the proposed work."
Section 105.5 Expiration.
Delete all and insert "Every permit issued shall become invalid unless the work authorized by such permit is commenced within 180 days after its issuance or after commencement of work if more than 180 days pass between inspections. The Building Official is authorized to grant, in writing, one permit renewal or reissuance, for a period not to exceed 180 days. The renewal or reissuance shall be requested in writing and justifiable cause demonstrated. The Village Manager is authorized to grant, in writing, any subsequent permit renewals or reissuances, for periods not to exceed 180 days. Any subsequent renewals or reissuances shall be in writing and justifiable cause demonstrated. However, no permit or approval shall be valid for a period of more than one year after the date of issuance."
Add (new section) 105.5.1 Permit fee extension.
Insert "The Building Official is authorized to grant, in writing, one permit extension, for a period not to exceed 180 days. The extension shall be requested in writing and justifiable cause demonstrated using the approved form. The Village Manager is authorized to grant, in writing, any subsequent permit extensions, for periods not to exceed 180 days. Any subsequent extensions shall be in writing and justifiable cause demonstrated using the approved form. (Refer to Village's Annual Fee Resolution, and Section 14-2-3 of the Village Code)."
Add (new section) 105.5.2 Permit fee renewal.
Insert "There shall not be any fee for the first renewal or reissuance of any permit that extends the validity of the initial permit for a period not to exceed 180 days. The fee for any subsequent renewal or reissuance of any permit that extends the validity of the initial permit for additional periods not to exceed 180 days shall be assessed at 25% of the original cost of the original permit."
Section 106.1 Submittal documents.
Delete all and insert "Construction documents for new single-family dwellings, two-family dwellings, townhouse dwellings, duplex dwellings, additions to dwelling units above the first floor, modifications which alter the roof of a dwelling unit of a substantial scope as determined by the Building Official, shall be signed and sealed by an Illinois licensed architect or structural engineer."
Section 106.2 Site Plan or plot plan.
Delete all and insert "The construction documents submitted with the application for permit shall be accompanied by a site plan showing the size and location of new construction and existing structures on the site and distances from lot lines. The site and grading plan shall be submitted in both paper and electronic versions. In the case of demolition, the site plan shall show construction to be demolished and the location and size of existing structures and construction that are to remain on the site or plot. The Building Official is authorized to waive or modify the requirement for a site plan where the application for permit is for alteration or repair or where otherwise warranted."
Section 108.2 Schedule of permit fees.
Delete all and insert "On buildings, structures, electrical, gas, mechanical and plumbing systems or alterations requiring a permit, a fee for each permit shall be paid as required, in accordance with the schedule as established by the applicable governing authority. See Village's Annual Fee Resolution."[2]
And insert lines (A, 1 through 2) as follows:
"A.
A fee for each plan examination, building permit and inspection shall be paid prior to the issuance of permit(s) in accordance with the following schedule:
"1.
Building permit fees are set forth in the Village's Annual Fee Resolution. Whenever the cost of construction is a factor in determining a permit or plan review fee, the valuation of building projects shall be established based on the greater of:
"a.
The cost of construction established by the International Code Council (ICC) and published on its website. The most current schedule shall be used based upon ICC published data; or
"b.
The cost of construction as stated by the applicant or agent on the application for the relevant permit.
"2.
Building plan review fees are set forth in the Village's Annual Fee Resolution. Further, an Amendment Form is required to be submitted detailing the changes for any revisions from previously approved plans. For building plans that have been previously reviewed, and the permit issued, any revisions to the building plan that, based upon the changes proposed require the review of two or more disciplines, a plan review fee for the Amendment Form is set forth in the Village's Annual Fee Resolution."
Add (new section)108.2.1 Recovery of third-party fees.
Insert "The Village may recover all third-party vendor and consultant fees incurred by the Village for residential plan review and residential inspection. Said costs may be added to the permit fees or collected prior to the issuance of a certificate of occupancy."
Add (new section) 109.1.6.2 Final storm sewer inspection.
Insert "A final inspection of the storm sewer, if installed, shall be scheduled with and approved by the Public Works Department prior to the issuance of a certificate of occupancy."
Add section 109.5 Final grading or topography survey.
Insert "If the topography of the land or property has been materially altered in connection with any work completed thereon, a final grading/topography survey, by an Illinois Land Surveyor, shall be submitted to the Village for review prior to the issuance of a certificate of occupancy. The survey shall be submitted in both paper and electronic versions and shall include the location of the water meter."
Add (new section) 110.4.1 Deposit and compliance.
Insert "Prior to the granting of a temporary certificate of occupancy, the applicant shall submit a deposit equal to 110% of the cost of completion of all outstanding items necessitating the request for a temporary certificate of occupancy. The deposit shall be forfeited to the Village upon noncompletion of any outstanding items prior to the expiration of the temporary certificate of occupancy."
Section 112 Board of Appeals.
Delete in its entirety and insert new section title "112 Appeals."
Add (new section) 112.1 General.
Insert lines (A, 1 through 3, B and C) as follows:
"A.
Any person shall have the right to appeal a decision of the Building Official to the Village Manager. A letter for appeal shall be based on a claim for one of the following three reasons:
"1.
That the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted, or
"2.
The provisions of this code do not fully apply, or
"3.
An equivalent or better method of construction is proposed.
"B.
All appeals shall be filed within thirty days of the decision of the Building Official.
"C.
The Village Manager shall affirm, modify, or reverse the decision of the Building Official."
Section 113.4 Violation penalties.
Delete all and insert "Any person who violates a provision of this code or fails to comply with any of the requirements thereof or who erects, constructs, alters or repairs a building or structure in violation of the approved construction documents or directive of the Building Official, or of a permit or certificate issued under the provisions of this code, shall be subject to penalties as prescribed by law or as set forth in the Village's Annual Fee Resolution."
Section 114.2 Unlawful continuance.
After paragraph insert "Violation of unlawful continuance is subject to either penalties as prescribed by law or as set forth in the Village's Annual Fee Resolution."
Add (new section) 114.3 Appeals.
Insert "Any permittee who is served with a stop-work order shall have the right to appeal the issuance of the stop-work order to the Village Manager, by filing a written appeal within seven days after the issuance of the stop-work order. The Village Manager shall, within seven days after receipt of the properly filed appeal, either (a) affirm the issuance of the stop-work order, or (b) rescind or modify the stop-work order. The failure of the Village Manager to render a decision within seven days shall be deemed as an affirmance by the Village Manager of the issuance of the stop-work order. All decisions of the Village Manager made pursuant to this Section 114.3 shall be final."

a.
Where weathering requires a higher strength concrete or grade of masonry than necessary to satisfy the structural requirements of this code, the frost line depth strength required for weathering shall govern. The weathering column shall be filled in with the weathering index, negligible, moderate, or severe for concrete as determined from Figure R301.2(4). The grade of masonry units shall be determined from ASTMC34, C55, C62, C73, C90, C129, C145, C216 or C652.
b.
Where the frost line depth requires deeper footings than indicated in Figure R403.1(1), the frost line depth strength required for weathering shall govern. The jurisdiction shall fill in the frost line depth column with the minimum depth of footing below finish grade.
c.
The jurisdiction shall fill in this part of the table to indicate the need for protection depending on whether there has been a history of local subterranean termite damage.
d.
The jurisdiction shall fill in this part of the table with the wind speed from the basic wind speed map [Figure R301.2(5)A]. Wind exposure category shall be determined on a site-specific basis in accordance with Section R301.2.1.4.

The outdoor design dry-bulb temperature shall be selected from the columns of 971/2-percent values for winter from Appendix D of the International Plumbing Code. Deviations from the Appendix D temperatures shall be permitted to reflect local climates or local weather experience as determined by the Building Official. [Also see Figure R301.2(1).]

The jurisdiction shall fill in this part of the table with the seismic design category determined from Section R301.2.2.1.

h.
In accordance with Sections R905.1.2, R905.4.3.1, R905.5.3.1, R905.6.3.1, R905.7.3.1 and R905.8.3.1, where there has been a history of local damage from the effects of ice damming, the jurisdiction shall fill in this part of the table with YES. Section 302.1 Exterior walls.

Section 303.4 Mechanical ventilation.
Delete all and insert "Where the air infiltration rate of a dwelling unit is 5 air changes per hour or less where tested with a blower door at a pressure of 0.2 inch w.c (50 Pa) in accordance with the 2018 Illinois Energy Conservation Code Section R402.4.1.2, the dwelling unit shall be provided with whole-house mechanical ventilation in accordance with Section M1505.4.
Section 309.5 Fire sprinklers.
Delete all and insert "Private garages shall be protected by fire sprinklers where the garage wall has been designed based on Table R302.1(2), Note a. Sprinklers in garages shall be connected to an automatic sprinkler system in accordance with NFPA 13D. Garage sprinklers shall be residential sprinklers or quick-response sprinklers, designed to provide a density of 0.05 gpm/ft2. Garage doors shall not be considered obstructions with respect to sprinkler placement.
Section 310.4 Bars, grilles, covers and screens.
Delete all and insert "Bars, grilles, covers, screens or similar devices shall be placed over emergency escape and rescue openings, area wells, or window wells, and the minimum net clear opening size shall comply with Sections R310.2.1 through R310.2.3, and such devices shall be releasable or removable from the inside without the use of a key, tool, special knowledge or force greater than that required for the normal operation of the escape and rescue opening.
Add (new section) 312.1.5 Design.
Insert "Guards shall not be designed or installed in such a manner as to create a ladder effect."
Section 313.1 Townhouse automatic fire sprinkler systems. Exception:

Section 322.1.7 Protection of water supply and sanitary sewer system.
Delete all and insert "New and replacement water supply systems shall be designed to minimize or eliminate infiltration of floodwaters into the systems in accordance with the plumbing provisions of this code. New and replacement sanitary sewage systems shall be designed to minimize or eliminate infiltration of floodwaters into systems and discharges from systems into floodwaters in accordance with the 2014 Illinois Plumbing Code and the Village of Lincolnwood Ordinance Chapter 12 Water and Sewers."
Section 401.3 Drainage.
Delete all and insert "Surface drainage shall utilize methods of conveyance and/or detention to manage stormwater in a way that does not create adverse impacts on neighboring properties. Lots shall be graded to drain surface water away from foundation walls. The grade shall fall not fewer than six inches (152 mm) within the first 10 feet (3048 mm)."
Section 401.4 Soil tests.
Delete all and insert "Where quantifiable data created by accepted soil science methodologies indicate expansive soils, compressible soils, shifting soils or other questionable soil characteristics are likely to be present, the Building Official shall determine whether to require a soil test to determine the soil's characteristics at a particular location. This test shall be done by an approved agency using an approved method.
"Where the top of a proposed concrete floor slab is set at 8' 0" below grade, soil borings shall be performed and a geotechnical report showing the determination of seasonally high water tables shall be provided to the Village. Based on those determinations, a drainage plan shall be provided at time of permit submittal that demonstrates how groundwater discharge will be mitigated without negative impacts to the public right-of-way or adjacent properties to the satisfaction of the Village Engineer."
Add (new section) 401.4.3 Bracing, shoring and reinforcement requirements.
Insert "For any excavation greater than three feet in depth occurring within five feet of any property line or right-of-way, the owner of the property to be excavated shall reinforce or brace adjacent land, buildings and structures so as to prevent any sagging, settling, cracking or collapse occurring to the adjacent land, sidewalks, fences, structures, foundations or walls. Where bracing, shoring or reinforcement is required because of the depth of excavation and distance to the property line or right-of-way, and where that excavation is less than five feet in depth, an Illinois-licensed architect or professional engineer shall design such bracing, shoring or reinforcement, and shall stamp and seal the plans therefor. Where that excavation is five feet or greater in depth, an Illinois-licensed structural engineer shall design such bracing, shoring or reinforcement, and shall stamp and seal the plans therefor. Installation of the bracing, shoring or reinforcement shall be in accordance with such design requirements and as directed by the structural or professional engineer. The owner of the property to be excavated shall be responsible for the cost of any required bracing, shoring or reinforcement."

Section 507.1 Decks.
Delete all and insert "Wood-framed decks shall be in accordance with this section, the 2015 or most current AWC DCA6 Prescriptive Residential Wood Deck Construction Guide, the ICC Deck Construction guide based on the 2021 International Residential Code or Section 301 for materials and conditions not prescribed herein. Where supported by attachment to an exterior wall, decks shall be positively anchored to the primary structure and designed for both vertical and lateral loads.
"Such attachment shall not be accomplished by use of toenails or nails subject to withdrawal. Where positive connection to the primary building structure cannot be verified during inspection, decks shall be self-supporting. For decks with cantilevered framing members, connections to exterior walls or other framing members shall be designed and constructed to resist uplift resulting from the full live load specified in Table R301.5 acting on a cantilevered portion of the deck."
Section 602.4 Interior load-bearing walls.
Delete all and insert "Interior load-bearing walls shall be constructed, framed and fireblocked as specified for exterior walls. Interior load-bearing walls that contain plumbing fixtures, flues or ducts shall be constructed of a minimum two-inch by six-inch lumber."
Section 602.5 Interior nonbearing walls.
Delete all and insert "Interior nonbearing walls shall be permitted to be constructed with 2-inch by 3-inch (51 mm by 76 mm) studs spaced 24 inches (610 mm) on center or, where not part of a braced wall line, 2-inch by 4-inch (51 mm by 102 mm) flat studs spaced at 16 inches (406 mm) on center. Interior nonbearing walls that contain plumbing fixtures, flues or ducts shall be constructed of a minimum two-inch by six-inch lumber. Interior nonbearing walls shall be capped with not less than a single top plate. Interior nonbearing walls shall be fireblocked in accordance with Section R602.8."
