The Borough of Green Tree hereby adopts as its policy on the
maintenance and inspection of its employee personnel files, the Act
of November 26, 1978 (P.L. 1212, No. 286), as amended and set forth
at 43 P.S. § 1321 and known as the "Inspection of Employment
Records Law" ("Act").
The definition of the terms "employee," "employer" and "personnel
file" shall be as set forth in the said Act.
Within 90 days of the adoption of this article, the Borough
of Green Tree shall perform a review of all existing employee personnel
file folders to bring them into compliance with the definition of
"personnel file."
All documents currently placed in an employee's file folder
that are not in compliance with the definition of "personnel file"
shall be removed from the personnel file and maintained in a separate
folder under each employee's name, and marked as "Non-personnel
file."
All personnel files and all non-personnel file documents for
each employee shall thereafter be solely maintained in the administrative
offices of the Borough of Green Tree.
The right of any employee to inspect his/her personnel file
shall be as set forth in 43 P.S. § 1322 et seq., and shall
require the employee to submit a written request to the Borough Manager
on a Borough form to inspect his/her personnel file. The personnel
file shall be available only during the normal business hours of the
administrative office of the Borough of Green Tree, and may be inspected
only during the free time of the employee.
An employee shall have the right to use a Designated Agent as
set forth in 43 P.S. § 1322.1.
The manner, method, location and frequency with which an employee
may inspect his/her personnel file shall be as set forth in 43 P.S.
§ 1323.
The enforcement of this Policy shall be as set forth in 43 P.S.
§ 1324.
A true and correct copy of 43 P.S. §§ 1321 through
1324 is attached hereto, made a part hereof and incorporated by reference.
To the extent any section of the Act is hereinafter amended, this
article shall be deemed amended so as to remain in compliance with
the said Act.
