As used in this chapter, the following terms shall have the
meanings indicated:
DEMONSTRATION
Includes the following:
A.
Any picketing or similar conduct;
B.
Any oration, speech, use of sound amplification equipment or
device, or similar conduct that is not part of a funeral;
C.
The display of any placard, banner, flag, or similar device,
unless such a display is part of a funeral; or
D.
The distribution of any handbill, pamphlet, leaflet, or other
written or printed matter other than a program distributed as part
of a funeral.
FUNERAL
The ceremonies, processions and memorial services held in
connection with the burial or cremation of the dead.
SPEECH OF PUBLIC CONCERN
Speech that can be fairly considered as relating to any matter
of political, social, or other concern to the community or when it
"is a subject of legitimate news interest," that is, a subject of
general interest and of value and concern to the public.
It is unlawful for any person to:
A. Engage in a demonstration at any public location within 1,000 feet
of the funeral, funeral procession, funeral home, church, synagogue,
temple or other place of public worship, cemetery, mortuary or other
location where a funeral is held or conducted, within one hour prior
to the scheduled commencement of a funeral, during a funeral, or within
two hours following the completion of a funeral. For the purposes
of this section, the distance of 1,000 feet shall be measured from
the property line of the location of the event;
B. Knowingly obstruct, hinder, impede, or block another person's
entry to or from a funeral;
C. Knowingly impede vehicles which are part of a funeral procession;
D. Display any visual images that convey fighting words or actual or
veiled threats against any other person;
E. Make or assist in the making of noise, diversions, or threatening
gestures, or engage in any other disruptive conduct that disrupts
or tends to disrupt the peace or good order of the funeral; or
F. Utilize any amplified speech, music or device during the funeral
services.
Any person violating or failing to comply with any of the provisions
of this chapter shall, upon conviction, be punishable by a fine of
not more than $1,000 and/or 90 days in the County jail. The imposition
of a penalty for a violation of this chapter shall not excuse the
violation nor permit it to continue. The continuation of such violation
shall constitute a separate offense.
