[HISTORY: Adopted by the Town Board of the Town of Poestenkill 11-13-1980 by L.L. No. 6-1980 (Ch. 5 of the 1986 Code). Amendments noted where applicable.]
The purpose of this chapter is to authorize public servants of the Town of Poestenkill to issue and serve appearance tickets in connection with violations of state statutes or of local laws, ordinances, rules, regulations or orders of the Town of Poestenkill which the public servants are authorized or required to enforce.
The following public servants of the Town of Poestenkill are hereby authorized to issue and serve appearance tickets with respect to violations of state statutes or of local laws, ordinances, rules, regulations or orders of the Town of Poestenkill dealing with the parenthetically indicated areas of responsibility that such public servants are, respectively, required or authorized to enforce:
A. 
Code Enforcement Officer (building, zoning and planning, fire prevention and safety, health and sanitation and licensing of occupations and businesses, including, particularly but not exclusively, the licensing and regulation of junk car lots within the Town of Poestenkill).
B. 
Dog Control Officer (licensing, regulation, control, harboring, confining, leashing, treatment and care of dogs within the Town of Poestenkill).
C. 
Peace officers (any statute, local law, ordinance, rule or regulation affecting the public health, safety and welfare).[1]

Nothing contained in this chapter is intended or should be construed to in any way limit or abridge the existing authority of police officers to also issue appearance tickets dealing with violations of state statutes or of local laws, ordinances, rules, regulations or orders of the Town of Poestenkill, regardless of whether or not such statutes or local legislation or regulations deal with the areas of responsibility described in § 5-2; rather, within such areas of responsibility, it is the intent and purpose of this chapter that the designated public officials and police will be possessed of concurrent jurisdiction and authority to issue appearance tickets, and that said tickets may be issued either by the police or by the designated public official.

An appearance ticket, other than for a parking violation, shall be served personally or by certified mail.
