In order to facilitate the movement of traffic and to combat
the hazards of snow and ice on the streets and roads of the Borough,
the Mayor or, in his absence, the President of Council of the Borough
of West Mifflin may, in their discretion, declare a snow and ice emergency.
Information on the existence of a snow emergency shall be given to
the public by the Borough through radio, newspaper, posting, personal
notification or other available media as the circumstances permit.
After any snow emergency is declared, it shall be unlawful,
at any time during the continuance of the emergency, for any person:
In addition to the declaration of a snow or ice emergency, the
Borough Street Commissioner or his designee may, at any time, in order
to facilitate the movement of traffic and to combat the hazards of
snow and ice on the streets and roads, establish a snow removal schedule
for the various streets and roads. The Street Commissioner or his
designee shall notify and require the owners of vehicles to periodically
remove vehicles from the streets and roads to facilitate snow and
ice removal. The Street Commission may request the aid of the Borough's
Police Department to remove vehicles from streets and roads during
designated snow and ice removal periods.
No vehicle shall be permitted to stand or park upon any street
for a twenty-four-hour period, or, at a minimum, until the street
is plowed, following the accumulation of two or more inches of snow
and/or ice. In the event that two or more inches have accumulated
since the last plowing of the street, then the no parking ban on said
street shall go back into effect until the street is replowed.
A.
A police officer of the Borough of West Mifflin may remove or have removed any vehicle which is parked or left unattended in violation of the provisions of §§ 274-54 and 274-56 of this article. Additionally, any car that is being driven without snow tires or chains on any street or road or any parked or unattended vehicles without chains or snow tires on the streets or roads during periods of snow accumulation may be removed at the discrepancy of a police officer of the Borough of West Mifflin or at the direction of the Street Commissioner of the Borough of West Mifflin. The removal of any parked or unattended vehicle or vehicles in violation of this article shall be at the reasonable expense of the owners of the vehicle. The tow truck operator shall have a lien against the owner of the vehicle in the amount of a reasonable value of the cost of removal of the vehicle and the cost of storage of the vehicle.
B.
The police or street crew shall give the owner or custodian of the
vehicle immediate notification of towing, if possible, and, in the
event immediate oral notification is not possible, the Police Department
shall send a notice by certified mail to the last registered owner
of the vehicle, informing the owner of the place and location of the
vehicle and of the owner's responsibility to pay the towing and
storage costs. Said notice shall be done as soon as possible, but
notice shall be mailed by first-class mail no later than 48 hours
after the removal of the vehicle.
A.
If, at any time during a period of snow emergency declared under § 274-54A or 274-56 of this article, a person shall park a motor vehicle or allow a motor vehicle to be parked anywhere upon a snow emergency route, or if the vehicle was permitted to stand or park upon any street for a period of 24 hours, or until the street is plowed, following the accumulation of two or more inches of snow and/or ice, and if adjudicated guilty of a violation of either § 274-53 or 274-56 of this article, then, upon conviction, he shall be sentenced and fined not more than $15 and costs.
B.
If, at any time during a period of snow emergency declared under § 274-54B of this article, a person shall drive a motor vehicle upon a snow emergency route without first having that vehicle equipped with snow tires or chains, that person shall be guilty of a violation of this article and, upon conviction, shall be sentenced to pay a fine of $25 and costs.
