A Police Department is hereby established in and for the Borough
of West Mifflin.

The Chief of Police shall make personnel assignments from time to
time to the Detective Division. An assignment to the Detective Division
is not a permanent assignment, and such personnel may be transferred
back to the Uniform Division at the discretion of the Chief. During
the period a police officer is assigned to the Detective Division,
such police officer shall be called a "detective of the West Mifflin
Police Department."
It is hereby created, provided and established a grade within
the Police Department of the Borough of West Mifflin designated as
Chief of Police, who shall be the chief executive of the Police Department.
The duties and responsibilities of the Chief of Police are as follows:
A.
The Chief of Police shall direct the police work of the Borough of
West Mifflin and be responsible for the enforcement and maintenance
of law and order and shall:
(1)
Assume responsibility for the overall administration and operation
of the Police Department.
(2)
Provide for officer training in order that high professional standards
can be maintained. The Chief may designate competent officers within
the Department to act as police instructors. Such officers shall conduct
such schools as the Chief shall order.
(3)
Prepare and post schedules of subordinate police officers' working
hours.
(4)
Make divisional assignments; assign officers to each division of
the Department. Reassignment from one division to another shall only
be made by the Chief of Police.
(5)
Prepare and post vacation schedules.
(6)
Maintain discipline of all police personnel.
(7)
Coordinate all police activity.
(8)
Coordinate police and public relations efforts.
(9)
Assume responsibility for all files, equipment, records and data
in the Police Department.
(10)
Direct and assign all Borough employees attached to the Police Department.

A.
It is hereby created, provided and established a grade within the
Police Department of the Borough of West Mifflin designated as Assistant
Chief of Police who shall be the second highest ranking officer in
the Police Department. The duties and responsibilities of the Assistant
Chief of Police are as follows:
(1)
To obey and respond to all orders of the Chief of Police.
(2)
To assume command of the Police Department in the absence of the
Chief of Police.
(3)
To supervise and coordinate the activities of the officers in the
Department.
(4)
To coordinate the intra-departmental activities within the Police
Department and coordinate inter-departmental activities with any other
police departments.
(5)
To provide for the maintenance and care of all equipment used by
the Police Department.
(6)
To attend regularly scheduled meetings of Borough Council, as needed,
to update the Mayor and members of Borough Council on matters of importance.
(7)
To report to and bring to the attention of the Chief of Police any
personnel issues and personnel concerns.
(8)
To assist the Chief of Police with administrative duties and on matters
of discipline, investigate citizen complaints about police officers'
misconduct and services, and make recommendations of disciplinary
actions and related matters.
(9)
To assist in police officers' training schedules.
(10)
To assist the Chief of Police in the management and preparation
of the Police Department budget.
(11)
To administer the daily work schedule for changes and manpower
decisions.
(12)
To maintain employee records concerning sick time, absences
and job related injuries.
(13)
To assist with the development and implementation of programs
and policies within the Police Department and in the preparation of
the monthly police report.
(14)
To address the media on behalf of the police Department, as
requested.
(15)
To assist the Chief of Police on purchasing responsibilities.
(16)
To assist with the formulation and preparation of the police
procedure manual.
(17)
To assist in and make recommendations regarding personnel matters,
including hiring and promotions.
A.
It hereby created, provided and established that the grade formerly
called the "Safety Officer" shall now be called "Captain." The duties
and responsibilities of the Captain are as follows:
(1)
To obey and respond to all orders of the Chief of Police.
(2)
To assume command of the Department in the Chief's absence.
(3)
To be in charge of traffic-related activities. The Captain will conduct
surveys, make recommendations, and act as a liaison with county and
state officials in traffic-related matters.
(4)
To train and instruct school guards.
(5)
To supervise and coordinate activities of the Detective Division.
(6)
To provide for the maintenance and care of all equipment utilized
by the Police Department. The Captain shall conduct surveys of the
equipment and make recommendations on the purchasing of new equipment
and the maintenance of existing equipment for the Police Department.
(7)
To be in charge of all nuisance-related matters affecting the health,
safety and welfare of the Borough, such as illegal dumping of garbage
and rubbish, junk cars and hazards.
B.
The grade of Captain shall be the second highest ranking police officer
in the Department.
It is hereby created, provided and established that the grade
of Lieutenant shall be now called "Divisional Lieutenant." The Police
Department of the Borough of West Mifflin shall have two Divisional
Lieutenants. The grade of Divisional Lieutenant shall be the third
highest ranking officer in the Department. The duties and responsibilities
of Divisional Lieutenants are as follows:
A.
To be familiar with and obey all orders and assignments of the Chief
of Police and/or Captain.
B.
Endeavor to create and maintain high morale among the men.
C.
Insure prompt, neat and accurate submission of all reports.
D.
Confer with the Chief of Police as to operational activities, investigations,
planning, and any problems that may arise; insure that information
is passed along to patrolmen and keep them well-informed; confer with
the Chief and the Captain and make recommendations for a more efficient
operation of the Police Department.
E.
Supervise and coordinate the activities of the officers in the Patrol
Division; coordinate intradepartmental activities within the Police
Department and coordinate interdepartmental activities with any other
Police Department.
F.
Evaluate subordinates at all levels.
G.
Be aware of training needs and instruct where possible.
H.
Make training recommendations to the Chief.
I.
Evaluate the morale of the Department and recommend corrective measures
to the Chief of Police.

A.
It is hereby created, provided and established that the grade of
Lieutenant Juvenile Division shall be now named "Assistant Divisional
Lieutenant." The duties and responsibilities of the Assistant Divisional
Lieutenant are as follows:
(1)
To be familiar with and obey all orders and assignments of superior
officers.
(2)
Endeavor to create and maintain a high morale among the men.
(3)
Confer with the Chief of Police and superior officers as to the operational
activities, investigations, planning, and any problems that may arise;
insure that the information is passed along to Sergeants and patrolmen
to keep them all informed; confer with the Chief and superior officers
and make recommendations for more efficient operation of the Police
Department.
(4)
Supervise and coordinate the activities of police officers involved
in the following:
(a)
The investigation of crimes involving juveniles.
(b)
The prevention and control of juvenile delinquency.
(c)
Supervise and coordinate juvenile-related matters.
(d)
Coordinate police activities involving juveniles and the public.
(e)
Conduct surveys and make recommendations to the Chief for instructional
programs to the public and juveniles concerning the health, safety
and welfare of juveniles.
B.
The grade of Assistant Divisional Lieutenant shall be the fourth
highest ranking officer in the Police Department.
A.
It is hereby created, provided and established and maintained the
rank of Sergeant. The duties and responsibilities of Sergeants are
as follows:
(1)
Be familiar with and obey all orders of superior officers.
(2)
Endeavor to create and maintain high morale among the men.
(3)
Supervise all officers on patrol.
(4)
Insure prompt, neat and accurate submission of all reports.
(5)
Confer with superior officers as to operational activities, investigation,
planning and any other problems that may arise.
(6)
Assume final responsibility for orders and assignment of men under
his command.
(8)
To take charge of any emergency arising while on duty. All serious
emergencies shall be referred to a superior officer for further direction.
(9)
To evaluate the morale and training needs of the Department and recommend
corrective measures to the proper superior officers.
B.
The grade of Sergeant shall be the fifth highest ranking officer
in the Police Department.
It is hereby created, provided and established the grade of
patrolman. The duties and responsibilities of a patrolman are as follows:
A.
To obey and respond to all orders and assignments of superior officers.
B.
To cooperate with all members of the Department and assist them in
achieving the Department's objectives.
C.
To be responsible for the accuracy and completion of all reports.
D.
To have basic knowledge of all laws of the commonwealth relative
to the Police Department and of all ordinances of the Borough and
to refer violations of the same to the proper authority.
E.
To maintain radio contact with the base station at all times and
to notify the superior in charge of the duty turn before leaving the
patrol car.
F.
To investigate all suspicious actions for information and/or further
investigation.
G.
To render assistance to the public in need of aid.
H.
To conduct investigations, take control of property where necessary,
secure the site of a crime for discovery of evidence, take control
of any evidence and to report the findings and turn over any property
or physical evidence to the proper superior officer.
It is hereby established that the following duties apply to
all police officers of the Borough of West Mifflin:
A.
To be responsible for the preservation of the public peace, the protection
of life and property and the general good of the Borough.
B.
To report to a superior officer any violation of orders or regulations
of the Department and any misconduct to any police officers to a superior
officer.
C.
To report promptly for duty wearing the proper uniform and maintain
a neat appearance.
D.
To maintain a polite and courteous manner to the public at all times.
Pursuant to and consistent with the laws of the Commonwealth
of Pennsylvania, the United States of America and the ordinances of
the Borough of West Mifflin, police officers of the Borough of West
Mifflin are hereby granted the authority and the power to enforce
the laws of the Commonwealth of Pennsylvania and the ordinances of
the Borough of West Mifflin, including, but not limited to, investigating,
arresting for probable cause and committing for hearing all actors
suspected of violating or breaching the laws of the Commonwealth of
Pennsylvania and the ordinances of the Borough of West Mifflin.
The number of persons to serve in each grade on a full-time
basis or part-time basis and the compensation of each shall be as
determined by the Council of the Borough of West Mifflin from time
to time.
In the absence or unavailability of a Sergeant, the Chief may
designate a patrolman as officer in charge. Said designated officer
in charge shall assume the duties and responsibilities of a Sergeant
until relieved. In the event that police officers of equal rank are
in a situation where one should assume command and no officer has
been designated as officer in charge, then the officer with the senior
time in grade shall be in charge. Said officer shall report the situation
to a superior officer as soon as possible under the circumstances
for further direction.
A.
Applicants for a vacant position within the Police Department as
set forth in this chapter shall apply to the Civil Service Commission
of the Borough and shall be subject to the Commission's rules for
competitive examination.
B.
Provided, however, that the rules and regulations necessary to establish
minimum qualifications shall first be submitted to Council for study
and approval, and it is hereby mandated that the Commission, by rule
or regulation, requires policemen to become residents of the Borough
of West Mifflin after appointment to such position.
C.
Provided further, however, that the appointment of Chief of Police
is excluded from this section, and the appointment of said Chief shall
be made by Council in accordance with the existing applicable law.
This section shall not be construed to limit or prevent Council from
making provisional appointments pursuant to Section 1187 of the Borough
Code, 53 P.S. § 46187. Any other appointment of the grade
patrolman through Captain, inclusive, shall be made in accordance
with the Borough Code, as amended, Act of February 1, 1966, P.L. (1965)
1656, No. 581, § 1184, 53 P.S. § 46184.
Nothing herein contained shall effect the authority of the Mayor
to appoint special police during emergencies.
