This article shall apply to any receptacle for water or any
artificial pool of water erected above or below ground level which
has a depth at any point of more than two feet and which is intended
or used for the total or partial immersion therein of human beings
for recreational purposes.
Any person, firm, partnership or corporation desiring to construct,
alter, maintain or repair a permanent-type, below-ground-level, private
swimming pool shall apply to the Building Inspector of the Borough
for a permit to construct, alter, maintain or repair the swimming
pool and shall submit to the Building Inspector, in addition to the
application for permit, detailed plans and specifications, in duplicate,
setting forth the extent and character of the installation in all
its structural parts and a plot plan, drawn to scale, showing the
location of the proposed swimming pool and all elevations.
All other swimming pools of a portable nature must be constructed
of a material which will provide a tight tank and easily cleaned surface.
All swimming pool installations shall comply with the health
and sanitary regulations of the Commonwealth of Pennsylvania and the
County of Allegheny regulating swimming pools.

All swimming pool installations shall comply with all ordinances of the Borough of West Mifflin and, in particular, Chapter
100, Construction Codes, Uniform, and Chapter
290, Zoning, as amended. The front yard, rear yard and side yard requirements of Chapter
290, Zoning, shall, in particular, be strictly observed. No portable swimming pool, furthermore, shall be allowed in the front yard of any dwelling as defined in Chapter
290, Zoning.

Every swimming pool installation shall be enclosed by a fence
having a height of at least four feet. No holes or other openings
in such fence, other than the regular points of entry, shall have
a length or width in excess of two inches. All points of entry into
the area of the swimming pool shall be equipped with a secured gate
having a locking device on the pool side, which locking device shall
be inaccessible to small children.

No pool shall provide a diving board unless sufficient space for diving shall have been provided for to a depth of eight feet and said diving board is approved by the Building Inspector of the Borough in accordance with the standards of Chapter
100, Construction Codes, Uniform.
All electrical wiring installed or used in conjunction with
any swimming pool shall be in conformity with the National Electrical
Code Standards, and the materials used or installed shall be as provided
by the National Underwriters Laboratory.
The inspection and enforcement provisions of Chapter
290, Zoning, and the said Chapter
100, Construction Codes, Uniform, shall apply to swimming pools.
The permit fee for the installation or alteration of permanent-type
swimming pools shall be the same as for a building of the same cost,
as has already or may be established by the Council of the Borough
of West Mifflin.

Any person, firm or corporation who shall violate any provision
of this article shall, upon conviction thereof, be sentenced to pay
a fine of not more than $600, plus costs, and, in default of payment
of said fine and costs, to a term of imprisonment not to exceed 30
days. Each day that a violation of this article continues shall constitute
a separate offense.

This article shall apply to any receptacle for water or any
artificial pool of water erected above or below ground level which
has a depth at any point of more than two feet and which is intended
or used for the total or partial immersion therein of human beings
for bathing or recreational purposes.
Any person, firm, partnership or corporation having or desiring to have within the Borough the receptacle described in §
254-12 of this article must register annually and apply for a permit for the same with the Building Inspector of the Borough.
Any person, firm, partnership or corporation having an existing
swimming pool must register, and the permit for the same must be obtained
annually on or before the 31st day of May of each year.
Any person, firm, partnership or corporation desiring to install
or erect a new swimming pool must register, and the permit for the
same must be obtained before the erection or installation.
This article does not amend, alter, revise or repeal any of the provisions set forth in Article
I, Construction Standards, of this chapter, but it is to be construed as a requirement in addition thereto.
