As used in this article, the following terms shall have the meanings indicated:
SMOKING
The burning of a lighted cigar, cigarette, pipe or any other matter or substance which contains tobacco.
A. 
Smoking is prohibited in all municipal buildings at all times. This prohibition includes, but is not limited to, all areas, offices, common areas, hallways and council chambers. It also includes all outdoor areas within 10 linear feet from any and all entrances and exits to all municipal buildings, thereby ensuring that tobacco smoke does not enter the smoke-free outdoor area through entrances, windows, ventilation systems or any other means.

B. 
Smoking shall be prohibited in all four firehouses in all areas at all times.
The penalty shall be that of a petty disorderly person's offense pursuant to N.J.S.A. 2C:43-3, except that the maximum fine which can be imposed for violation of this article is $200.
