It is the intent of this Article III, regulating residential development in the Borough of Trainer, to provide for a full range of types and sizes of dwellings. It is further the intent of this Article III to preserve the character and integrity of existing residential neighborhoods of the Borough, while recognizing the need to encourage residential rehabilitation.

A. 
Use regulations.
(1) 
Permitted uses.
(a) 
Single-family detached dwellings on permanent foundations.
(b) 
Churches and other institutions of religion.
(c) 
Public and private schools.
(d) 
Nonprofit, charitable institutions.
(e) 
Publicly owned or operated park or recreation facility.
(2) 
Accessory uses. The following uses may be located on the same lot as permitted uses, provided that they are incidental to the principal use and that they meet all other appropriate requirements of this chapter, including the parking requirements.
(a) 
Office of a lawyer, physician, surgeon, dentist or other professional person, provided that not more than 25% of the total floor area is used for this purpose.
(b) 
Private garage or parking space.
(c) 
A private swimming pool constructed to the standards of the Borough Building Code and conforming to § 265-44.
(d) 
Signs as permitted in § 265-43.
(e) 
Child day care for six or fewer children under the age of 16. Child day care for more than six children under the age of 16 shall only be permitted in nonresidential zoning districts. (See Chapter 88, Article V, Child Day-Care Facilities.)
(3) 
Uses permitted by conditional use.
(a) 
Mobile home park which, when granted conditional use, shall be excluded from the bulk and area regulations of this chapter in favor of those set forth in Chapter 165, Mobile Homes and Mobile Home Parks.
B. 
Lot area. A lot area of not less than 5,000 square feet shall be provided for every dwelling hereafter erected or used in the R-1 District.
C. 
Lot width. The minimum lot width at the building line shall be 50 feet.
D. 
Street frontage. The minimum street frontage shall be 40 feet.
E. 
Height. A maximum of three stories or 25 feet, whichever is less.
F. 
Front yard. There shall be a front yard on each street upon which a lot abuts which shall be not less than 20 feet.
G. 
Rear yard. For hospitals and sanitoria there shall be a rear yard which shall be not less than 75 feet. For all other permitted uses there shall be a rear yard which shall be not less than 16 feet in depth.
H. 
Side yard. For hospitals and sanitoria there shall be two side yards which shall be not less than 75 feet. For all other permitted uses there shall be two side yards which shall be not less than eight feet in width, with an aggregate total of not less than 20 feet.
I. 
Coverage. Not more than 40% of the area of any lot may be occupied by buildings.
J. 
Space between buildings: not applicable within the R-1 District.
K. 
Parking and loading. Parking and loading shall be provided in accordance with requirements contained in § 265-42.
L. 
Approval of site plans. Site plans shall be prepared and submitted in accordance with § 265-53.

(a) 
Any use permitted in the R-1 Single-Family Residence District.
(b) 
Single-family, semidetached or twin dwelling, provided that the dwelling with which it has a party wall in common is erected at the same time;
(c) 
Two-family semidetached dwelling, including double-duplex dwellings, provided that the dwellings with which they have a party wall in common is erected at the same time.
(d) 
Two-family detached dwelling, including duplex dwellings.
(e) 
Boardinghouse, rooming or lodging house.
(2) 
Accessory uses. The following uses may be located on the same lot as permitted uses, provided that they are incidental to the principal use.
(a) 
Home occupation as defined in § 265-17.
(b) 
Private garage or parking space, provided that it is located in the rear yard and is not closer than five feet from any street line.
(c) 
A private swimming pool constructed to the standards of the Borough Building Code and conforming to § 265-44.
(d) 
Signs as permitted in § 265-43.
(e) 
Child day care for six or fewer children under the age of 16. Child day care for more than six children under the age of 16 shall only be permitted in nonresidential zoning districts. (See Chapter 88, Article V, Child Day-Care Facilities.)[1]

(3) 
Uses permitted as special exception by the Zoning Hearing Board.
(a) 
Clubs and lodges operated solely for the use of members and their guests, not as a business or for profit. Such uses must meet all other applicable requirements of this chapter and of the Commonwealth of Pennsylvania.
(b) 
Dependent care facility when properly licensed by the Commonwealth of Pennsylvania and meeting all other applicable requirements of this and other Borough codes and ordinances.
B. 
Lot area. The following shall be the minimum lot areas per dwelling unit permitted within the R-2 District.
(1) 
Single-family detached: minimum, 5,000 square feet.
(2) 
Single-family semidetached and two-family semidetached: minimum, 3,000 square feet.
C. 
Lot width. The following shall be the minimum lot width for every lot within the R-2 District, as measured at the building line.
(1) 
Single-family detached: minimum, 50 feet.
(2) 
Single-family semidetached and two-family semidetached: minimum, 30 feet.
D. 
Street frontage. The following shall be the minimum street frontage for every lot within the R-2 District, as measured at the street right-of-way line.
(1) 
Single-family detached: minimum, 40 feet.
(2) 
Single-family semidetached or two-family semidetached: minimum, 20 feet.
E. 
Height. A maximum of 3 1/2 stories or 35 feet, whichever is less.
F. 
Front yard. There shall be a front yard on each street upon which a lot abuts which shall be not less than 20 feet in depth.
G. 
Rear yard. There shall be a rear yard which shall be not less than 20 feet in depth.
H. 
Side yard. There shall be two side yards, neither of which shall be less than eight feet in width, with an aggregate total of not less than 20 feet.
I.

Multiple dwelling, including condominium and cooperative.
(d) 
Clubs and lodges operated solely for the use of members and their guests, not as a business or for profit. Such uses must meet all other applicable requirements of this chapter and of the Commonwealth of Pennsylvania.
(2) 
Accessory uses. Accessory uses shall be the same as those permitted in the R-2 General Residence District.
(3) 
Uses permitted as special exception by the Zoning Hearing Board.
(a) 
Dependent care facility when properly licensed by the Commonwealth of Pennsylvania and meeting all other applicable requirements of this and other Borough codes and ordinances.
B. 
Lot area. A lot area of not less than 2,200 square feet per dwelling shall be provided for every permitted use hereafter erected or used in the R-3 District, with the exception of single-family attached row house or townhouse, which shall be permitted at a density not to exceed 19 units per acre.
C. 
Lot width. The minimum lot width at the building line shall be as follows.
(1) 
Single-family detached: minimum, 50 feet.
(2) 
Single-family attached: minimum, 20 feet.
D. 
Street frontage. The following shall be the minimum street frontage for every lot within the R-2 District, as measured at the street right-of-way line.
(1) 
Single-family detached: minimum, 40 feet.
(2) 
Single-family attached: minimum, 15 feet.
E. 
Height. A maximum of 3 1/2 stories or 35 feet, whichever is less.
F. 
Front yard. There shall be a front yard on each street upon which a lot abuts which shall be not less than 20 feet in depth.
G. 
Rear yard. There shall be a rear yard which shall be not less than 20 feet in depth.
H. 
Side yard. There shall be two side yards, neither of which shall be less than eight feet in width, with an aggregate total of not less than 20 feet.
I. 
Coverage. Not more than 50% of the area of any lot may be occupied by buildings and not more than 85% may be occupied by all constructed improvements. The remaining 15% of the lot shall be devoted to usable open space, landscaping and similar uses.
J. 
Space between buildings. For groups of rental units of any type which are in a single and separate ownership, there shall be a minimum of 20 feet between the sides, 60 feet between the fronts, and 40 feet between the rears of the buildings within the group.
