An historical commission, hereinafter sometimes referred to in this article as the "Commission," is hereby established in accordance with the provisions of MGL c. 40, § 8D.

In accordance with Article 2, Section 2-10; Article 3, Section 3-3; and Article 6 of the City Charter, the Mayor shall appoint not less than three but no more than seven members to the Historical Commission, pursuant to MGL c. 40, § 8D, and subject to City Council approval.

All present and future members of the Historical Commission shall be classified as "special municipal employes" as that term is defined by MGL c. 268A, § 1(n), as amended. Such classification shall apply to Commission members only in the performance of their powers and duties as outlined in Chapter 2, Article XXII, of the Code of the City of Pittsfield and Massachusetts General Laws, including, but not limited to, MGL c. 40, § 8D.

Each member shall serve a term of three years. In the event of a vacancy, the Mayor shall appoint a successor as soon as practicable, subject to City Council approval, and said successor shall fulfill the unexpired term of the member whose seat was vacated.

The Historical Commission shall exercise and perform all the powers and duties conferred upon historical commissions by MGL c. 40, § 8D, and in addition shall perform such other duties, not inconsistent with such section, as may be imposed by law or ordinance. Subject to appropriation, the Commission may appoint such clerks and other employees as it may from time to time require and may expend money for any purpose authorized by such MGL c. 40, § 8D.
