There is hereby established, in the City of Pittsfield, a commission
to be known as the “Pittsfield Civic Center Commission.”

The commission shall be comprised of five members, to be appointed by the mayor, with the confirmation of the city council, in accordance with Article 2, Section
2-10 and Article 3, Section
3-3 of the City Charter enacted by Chapter 72 of the Acts of 2013, who shall serve without compensation.

The terms of office of the members originally appointed to the Pittsfield Civic Center Commission shall be as follows: Two of the members so appointed shall be appointed for terms of three years; and two members for terms of two years; and one member for a term of one year. As the terms of the members of the original commission expire their successors shall be appointed for terms of three years each. A vacancy occurring otherwise than by expiration of a term shall be filled for the unexpired term in the same manner as prescribed by §
2-157.

In accordance with Article
10, Section
10-6(a) of the City Charter enacted by Chapter 72 of the Acts of 2013, the members shall annually elect a chairman and a treasurer from among its members by a majority vote of its members.

(a) The commission shall act in behalf of the city in all contractual
matters relating to:
(1)
The acquisition of land and/or buildings for the purpose of
establishing a civic center.
(2)
Construction, reconstruction, rehabilitation, finish or expansion
of facilities for a civic center.
(3)
Employment of agents, managers and employees who may enter into
contracts and loans subject to the approval as to form by the city
solicitor, and they shall be employees of the city.
(4)
Oversight of on-going operation of the civic center.
(b) The commission will establish a special fund called “Civic
Center Fund.” All grant funds received from the commonwealth
and any other funds to be used for the civic center project will be
deposited in the civic center fund. These funds are to be expended
by the commission’s treasurer upon a majority vote of the commission.
An annual audit of the civic center fund is required to be submitted
to the commonwealth’s director of the bureau of accounts, and
the secretary of administration and finance.
(c) In addition to the duties and responsibilities listed herein, the
commission is further authorized to perform such duties and undertake
such projects as are authorized by rules and regulations promulgated
by the Commonwealth of Massachusetts Executive Office of Administration
and Finance, Massachusetts General Law 801 CMR 27.00 and subsequent
amendments thereto.
(d) The city council and the mayor shall hold jointly final approval
on the civic center project and other projects as submitted by the
commission. After such approval the commission will act as the administrative
agency for the project under their duties and responsibilities listed
herein. Major changes in project size, funding or scope shall be resubmitted
to the council/mayor for their approval.
