The Traffic Commission shall consist of five members, one of whom shall be a member of the Pittsfield City Council; another shall be the Police Chief or his/her designee. In accordance with Article 2, Section 2-10, Article 3, Section 3-3 and Article 6 of Chapter 72 of the Acts of 2013, the Mayor shall appoint all of the members to the Traffic Commission, subject to City Council approval. In accordance with Article 10, Section 10-6(a) of Chapter 72 of the Acts of 2013, the members of the Traffic Commission shall elect from the membership a chairperson, vice chairperson, a secretary and any other officers that the membership deems necessary. The Traffic Commission shall comply with the provisions set forth in Article 10, Section 10-6 of Chapter 72 of the Acts of 2013. Excepting the City Councilor and the Police Chief or his/her designee, who shall serve so long as they are serving in their official capacities, the remaining members shall serve for a term of three years. In the event of a vacancy, the Mayor shall appoint a successor as soon as practicable, subject to city council approval, and said successor shall fulfill the unexpired term of the member whose seat was vacated.

The traffic commission shall be responsible for the development of policies and practices for the regulation and control of traffic in the city. It shall advise the Commissioner of Public Services and the city council on matters relating to traffic, parking and accident prevention and shall make such reports and recommendations as it may deem in the public interest. It shall study and investigate all subjects and problems relating to the regulation of traffic or parking, either originally referred to it by the city council, Commissioner of Public Services or other public officials, or upon its own initiative. It shall perform such other duties and shall have such other responsibilities as may be conferred upon it by the city council.
In addition the traffic commission:
(a) 
Shall, acting through the Commissioner of Public Services, be responsible for the installation, maintenance and repair of parking areas and for the collection of all monies deposited therein or due for use or occupancy of parking meter spaces under section 13-74. Upon their collection, such monies shall be deposited in a national bank or trust company in the city in the name of the City of Pittsfield, Traffic Commission Account, and shall thereafter be paid into the city treasury in accordance with the provisions of section 6-5. All reports shall distinguish between receipts from meters in public ways and those in municipal parking areas.

(b) 
Shall advise the Commissioner of Public Services with regard to the laying out, construction and maintenance of municipal parking areas in or upon such premises as the city council may designate therefor by order approved by the mayor; and shall also advise as to the installation of meters on or upon any such municipal parking area as may be designated for such installation by the city council by order approved by the mayor.

(c) 
Shall cause, through the Commissioner of Public Services, to be installed, erected, constructed, operated and maintained all necessary and properly authorized signs, electrical signals, pavement markings, pylons, channels, islands, lanes, spotlights, crosswalks, safety zones, and other devices for guiding, directing, regulating and controlling vehicular and pedestrian traffic.

(d) 
Shall cause, through the Commissioner of Public Services, suitable signs, setting forth the name of the street, lane, alley or court to be placed on or near the corner of streets, lanes, alleys or courts in such style and in such number as it shall deem necessary and convenient.

(e) 
Shall annually, in January, report to the city council the business transacted during the preceding year and make such suggestions and recommendations as it may deem proper.
(f) 
Shall report and recommend to the Commissioner of Public Services and the mayor all funds which it deems necessary to be included in the annual budget of the Department of Public Services for the purpose of effectively performing its duties and responsibilities.

The city council shall refer every proposed order or ordinance for the regulation of traffic, and every proposed amendment thereto, to the traffic commission for its study and report with recommendations thereon. No final vote shall be taken by the city council on any such order or ordinance until such commission has submitted such report with recommendations in writing, or until 20 days shall have elapsed after the reference to the commission without the filing of such report with recommendations. The reports and recommendations of the traffic commission shall be advisory only, and shall not have the force or effect of law or ordinance.
