Upon receipt of a petition filed with the city council whereby
petitioners request the treatment of diseased trees on city property,
the Commissioner of Public Services shall determine that said treatment
is necessary and determine the cost of said treatment. If the petitioners
agree to pay 50% of said cost and deposit that sum with the commissioner,
he or she will arrange for said treatment to be performed.

The Commissioner of Public Services is hereby authorized and
empowered, subject to the laws of the commonwealth and any regulations
of a department thereof having the force of law, to use the facilities
of the Department of Public Services of the city in the manner of
the removal of trees, brush and other natural obstacles found within,
or extending over, the bed of any nonnavigable, natural stream, situated
within or flowing through the city; provided, that this may be done
with the consent of any riparian owners having rights therein, and
without cost to such riparian owners; and, provided, that such riparian
owners give proper waivers of damages, releasing the city and the
Commissioner of Public Services and employees in such department from
any liability by reason of their acts hereunder.

The City Council may, upon a petition for the removal of a tree
within the way of an unaccepted street to which the public has the
right of access, cause an investigation of said tree to be made by
the Commissioner of Public Services. If in the opinion of the Commissioner
said tree constitutes a hazard or a nuisance to the general public,
the City Council may order the removal of said tree by the Department
of Public Services of the City, provided that this may be done only
with the consent of all abutters having rights in said way, and without
cost to such abutters; and provided, further, that such abutters give
property waivers of damages, releasing the City and the Commission
of Public Services and employees in such Department from any liability
by reason of their acts hereunder.
