The maximum speed at which vehicles may proceed on or along
any highway within the Borough is hereby established at 25 miles per
hour, except on those highways forming part of the state highway system,
and except that the speed limit for vehicles proceeding on or along
those highways or parts of highways described below is hereby established
at the rate of speed indicated:

B. The provisions of this section shall be enforced according to the
law and provisions of §
140-31, Violations and penalties,
of the Borough Code of the Borough of Colwyn.
The intersections described below are hereby established as
yield-right-of-way intersections, and official yield signs shall be
erected in such a position upon the first-named highway as to face
traffic approaching the second-named highway in the direction or directions
indicated. All vehicles and tractors approaching any such intersection
upon the first-named highway, in the direction or directions indicated,
shall yield the right-of-way to any vehicle in the intersection or
approaching on the second-named highway so closely as to constitute
an immediate hazard during the time that the operator of such vehicle
or tractor is moving across or within such intersection.

A. It shall be unlawful for the owner or operator of any truck, truck-tractor,
tractor, tractor-trailer combination, trailer, semitrailer, bus, commercial
vehicle, tow truck, flatbed, flatbed towing truck, all-terrain vehicle
(ATV), motor home or recreational vehicle or van with kitchen or sleeping
facilities to park such vehicle or allow it to remain parked at any
time on any street or highway in any residential district of the Borough
of Colwyn, except for purposes of loading or unloading persons or
property or for making deliveries or rendering services to an owner
or tenant of the residence adjacent to the street or highway where
such vehicle is standing or parked. This section shall not apply to
a pickup truck, sports utility vehicle (SUV) or similar vehicle with
a registered gross vehicle weight of 10,000 pounds or less.
B. The provisions of this section shall not apply to:
(1) The vehicles of the Borough of Colwyn, fire apparatus, ambulances
or vehicles engaged in the work of a public utility.
(2) Vehicles actually engaged in the course of construction or repair
of streets while actually engaged in making deliveries or rendering
services in or upon any property adjacent to any street where said
vehicles are parked.
(3) Disabled motor vehicles which are subject to the provisions of Colwyn
Borough Code §§
140-32 and
140-33.
(4) During the period between November 15 and April 15, it will be permitted
for snow plows to be attached to pickup trucks, sports utility vehicles
(SUV) or similar vehicles with a registered gross vehicle weight of
10,000 pounds or less when said vehicles are parked on Borough streets.
At no time shall snow removal equipment be allowed to remain on the
Borough's streets unless properly attached to a licensed and
currently registered pickup truck, sports utility vehicle (SUV) or
similar vehicle with a registered gross vehicle weight of 10,000 pounds
or less.
C. Any vehicles found to be in violation of this section of the Borough
Code shall be deemed to be illegally parked, subject to a fine not
less than $100, nor to exceed $500, for each violation; each day a
vehicle is illegally parked shall constitute a separate violation
of this section of the Colwyn Borough Code. After five individual
violations have been issued in any twelve-month period, the offending
vehicle shall be towed from the Borough streets at the owner's
expense, and fines and costs, including legal fees and court costs,
shall be assessed against the owner and/or operator of the offending
motor vehicle. Further, the owner and/or operator of an offending
motor vehicle shall, in addition to the foregoing, be subject to all
of the provisions of Chapter
139 of the Colwyn Borough Code that are
not inconsistent with this section, including, but not limited to,
towing and impoundment in a facility of the Borough's choosing,
in addition to daily impoundment, towing and storage charges, at a
rate to be established by Borough Council.
