No person or persons, firm or corporation shall act, exhibit,
play or perform in any opera, circus, menagerie or exhibition of animals,
panorama, dancing hall or riding of horses, or conduct any amusement
park, moving picture theater, billiard room or bowling alley or any
other entertainment, show or amusement of whatsoever nature within
the Borough of West View, for which money or other reward is in any
manner demanded or received, without a license or permit for that
purpose or for any of the foregoing purposes until:
A. The management thereof has first obtained from the Secretary of the
Borough of West View a license or permit which shall express the purpose
or purposes for which said license or permit is issued.
B. There shall be paid, for the use of said Borough, the sum of $100
for each and every license or permit used for 24 hours or any part
thereof, or $2,500 for each and every license or permit for one year,
or any part thereof exceeding one day, except as provided below:

(1) Public dance halls. By reason of the relative brevity of public dances
and the small amount of public protection required in the supervision
thereof, the license fee for public dance halls, the floor space of
which is not more than approximately 6,700 square feet, shall be $20
per evening or $1,000 per year.

(2) Moving pictures. By reason of the peculiar character of moving picture
theaters, nickelodeons and theater entertainment, in that they require
little public protection and supervision and are ordinarily shown
throughout the year primarily for the enjoyment of the residents of
the Borough, the license or permit fee shall be $10 for one evening's
moving picture entertainment or $1,000 per year.

(3) Pool or billiard tables. By reason of the type and character of pool
and billiard rooms and bowling alleys, the annual license or permit
fee for the first pool or billiard table shall be the sum of $20 per
year and $10 for each additional table, and the annual license or
permit fee for bowling alleys shall be $10 for the first alley and
$2 for each additional alley.

The Secretary of the Borough shall not issue any license or
permit for any of the foregoing purposes if the same is of immoral
or indecent nature or against the peace or safety of the Borough,
and any such license so used may at any time be revoked or annulled.
Nothing in this chapter shall require the issuance of a license
or permit for any entertainment or amusement, as aforesaid, which
is given for charitable, benevolent or Borough purposes.

Any person or persons, firm or corporation giving such entertainment
or amusement, as aforesaid, without first obtaining the necessary
license or permit therefor shall be subject to a fine of not more
than $300, plus costs of prosecution, and in default of the payment
of the fine and costs, to imprisonment for not more than 30 days,
for each and every day on which such entertainment or amusement takes
place.
