It shall be unlawful to plant, place or maintain any North Carolina poplar tree or trees on the street, lanes or highways of the Borough or within 50 feet of any public sewer. The placing, planting or maintenance of the same is hereby declared to be a nuisance.
Any person or persons, firm or corporation violating any of the terms and conditions of this chapter shall, upon conviction thereof before a Magisterial District Judge, be subject to a fine of not more than $300, plus costs of prosecution, and in default of the payment of the fine and costs, to imprisonment for not more than 30 days. Such fine shall be recoverable as like penalties are by law recoverable. Each succeeding 24 hours that said tree or trees are maintained after the time fixed by this chapter for removal shall be deemed and taken as a new offense.
The Street Committee of the Council is hereby authorized and empowered to order and direct the removal of all trees planted, placed or maintained in violation of the terms of this chapter.
