A certain document, one copy of which is on file in the office of the Administration of the Borough of Northampton, which shall be the most recent version of the International Property Maintenance Code, as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Borough of Northampton, in the Commonwealth of Pennsylvania, for regulating and governing the conditions and maintenance of all property, buildings and structures by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of Northampton Borough are hereby referred to, adopted, and made a part hereof, as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in §
180-2 of this article.
The following sections are hereby revised as follows:
A. Section 101.1. In Section 101.1, where there is a reference in the
International Property Maintenance Code to "[name of jurisdiction],"
the following shall be inserted: "Northampton Borough, Commonwealth
of Pennsylvania."
B. Section 102.3. In Section 102.3, the following shall be added: "Repairs,
additions or alterations to a structure, or changes of occupancy,
shall be done in accordance with the procedures and provisions of
the applicable editions of the most current edition of the adopted
Pennsylvania Uniform Construction Code. Nothing in this code shall be construed to cancel, modify
or set aside any provision of the Zoning Ordinance."
C. Section 103.5. Section 103.5 shall be deleted and replaced with the
following: "The fees for activities and services assessed by the Borough
of Northampton for the administration, inspection and issuance of
permits and all other related matters undertaken pursuant to this
article and this code shall be established by the Borough of Northampton
by resolution from time to time."
D. Section 106.4 is amended to read as follows: "Any person who shall
violate a provision of this code, or fail to comply therewith, or
any of the requirements thereof, shall be prosecuted within the limits
provided for by state or local laws. Upon conviction of a summary
offense in accordance with the Borough Code at 8 Pa.C.S.A. § 3321,
the violator shall pay a fine not to exceed $1,000 for each day that
a violation continues after due notice has been served, plus court
costs and reasonable attorneys' fees. Each day that a violation
continues after due notice shall be deemed a separate offense."

This article may commonly be referred to as the Borough of Northampton
"Prohibition of Exterior Storage of Personal Property."
No owner, possessor or responsible agent of real property shall
accumulate, permit or store items such as furniture designed or manufactured
primarily for indoor use, durable goods (refrigerators, washers, dryers,
etc.), small appliances, carpets, tires, vehicle parts, automotive
products or municipal waste, hazardous waste, residual waste or construction
or demolition debris on the exterior of the property if it is a threat
to the physical appearance, safety or public health of the Borough
or if its presence constitutes a public nuisance.
Any person or entity who violates this article shall be charged
with a summary offense and upon conviction thereof before the appropriate
Magisterial District Judge, shall be sentenced to pay the costs plus
a fine levied as follows: $100 against a person or entity violating
this article, with each day of continued violation constituting a
separate offense, to a maximum fine not to exceed $1,000.
Nothing herein contained shall inhibit or impair the Borough
from enforcing its rights in law or equity.
