The activities listed hereinafter are specifically prohibited on any North Huntingdon Township park property. Exceptions to these prohibitions will be recognized only upon the possession and presentation of a written authorization signed by the Director of Parks or by signs posted by authorized representatives of the Township or by the immediate direction of a North Huntingdon Township Police Officer.
A. 
Motor vehicles.
(1) 
Driving or parking on grass areas or trails.
(2) 
Parking a vehicle on any park property when the owner/driver of the vehicle is not utilizing any park facilities. Violators will be tagged and towed.[1]

(3) 
Cleaning, polishing, washing, greasing, lubricating or repainting.
(4) 
Snowmobiles, dirt bikes and all-terrain vehicles.
B. 
Shrubs, flowers, trees, grass, turf, soil or rock formations. Picking, cutting, breaking, digging or injuring in any way.
C. 
Buildings, structures or park facilities. Damaging, defacing or misusing in any way.
D. 
Wastepaper, garbage and refuse.
(1) 
Scattering or depositing except in appropriate receptacles provided for that purpose.
(2) 
Failing to clean up and place all picnic wastepaper, garbage and refuse in receptacles provided for that purpose.
(3) 
Depositing in park receptacles wastepaper, garbage or refuse brought from outside the park.
E. 
Animals and birds.
(1) 
Molesting, trapping, hunting, killing or injuring in any way.
(2) 
Abandoning animals or birds within the parks.
(3) 
It shall be unlawful to feed or leave food behind with the sole intent or purpose of feeding the wildlife.

F. 
Lakes, streams and fountains.
(1) 
Wading, swimming or ice skating unless designated.[2]

Discharging of any types of waste or toxic materials into, or otherwise, contaminating, any lake, stream or fountain.
G. 
Advertising. Posting or distributing any notices, advertisements or handbills.
H. 
Weapons and explosives.
(1) 
Discharge of a firearm except in designated areas. Nothing contained in this article shall prohibit any person from carrying a firearm in accordance with the Pennsylvania Uniform Firearms Act,[3] or in accordance with other applicable laws and regulations.[4]

(2) 
Possession or setting off fireworks or explosive devices or the launching of rockets.
I. 
Merchandising. Offering, distributing, supplying, renting or selling any literature, commodity, article, material, equipment, service or supply, except by those doing so pursuant to § 379-2D and E, hereof.
J. 
Noise. Using electrical amplifying equipment.
K. 
Alcoholic beverages. Consumption of alcoholic beverages in any buildings or areas owned or maintained by the Township and specifically including parks is prohibited except as permitted under § 379-2L of this article.

L. 
Bottled beverages. All beverages in glass containers.
M. 
Domestic animals.

(1) 
Domestic animals are permitted on any North Huntingdon Township park property, with the exception of Indian Lake Park, where no domestic animals shall be permitted, other than domestic dogs, which shall be permitted.

(2) 
All domestic animals must be on a leash no longer than six feet in length, and under the owner's or possessor's control at all times.
(3) 
Domestic animals are not permitted on or within 20 feet of pavilions, playgrounds, athletic playing fields or in attendance at Township-sponsored social events.
(4) 
Owners are required to clean up after their domestic animals immediately.
N. 
Horseback riding. Horseback riding shall not be permitted on any North Huntingdon Township property except on designated horse trails and roads.

The activities listed hereinafter are permitted in any of the Township of North Huntingdon park areas, but are subject to the regulations listed herein and where posted in the appropriate area.
A. 
Recreational activities. Picnicking, swimming, tennis, golf, skating, bicycling, skiing, sledding, baseball, softball, basketball, football, boating, fishing, horseback riding, horseshoe pitching, model powered plane flying, and related and similar forms of recreation are permitted only in areas designed for such use, and in no case shall such use be permitted in areas where park facilities, areas, or park visitors can be injured.
B. 
Fires.
(1) 
Fires are permitted only in stoves, fireplaces, grills or similar designated areas and facilities and must be thoroughly extinguished before leaving the area;
(2) 
Matches, cigars, cigarettes and charcoal must be thoroughly extinguished before being disposed.
C. 
Animals. Horses are permitted only on designated horse trails and roads.
D. 
Sale of food and refreshments.
(1) 
Food and refreshments may be sold by concessionaires under the provisions of their respective concession agreements;
(2) 
If food and refreshment concessionaires are unwilling to provide such service at special events, the holders of the appropriate permits may provide that service for the public, subject to the provisions set forth by the Director.
E. 
Charging for admission to permit areas and buildings. The holders of permits for special-use areas who are engaged in a non-profit-making enterprise may charge the public for admission to an event. Such a charge is subject to the approval of the Township of North Huntingdon one week prior to the date of the permit.
F. 
Public gatherings. Meetings, assemblies, parades or related forms of public gatherings will be permitted upon possession and presentation of a written authorization through the Administration Office of the Township of North Huntingdon and signed by the Director of Parks.
G. 
Use of permit facilities. Permits are required to reserve buildings, shelters, pavilions, athletic fields and other facilities.
H. 
Fishing. Fishing, as regulated by the Pennsylvania Fish Commission, is permitted between the hours of 8:00 a.m. and sundown in Township of North Huntingdon parks.
I. 
Park hours.

(1) 
North Huntingdon Township parks will be open from 8:00 a.m. until sundown.
(2) 
The park hours for Indian Lake Park shall be to open at 5:00 a.m. and close at 10:00 p.m. on each day.
J. 
Handicapped facilities. Except for those individuals who are physically handicapped and those individuals required to assist handicapped individuals, no individual shall be permitted to use any designated "Handicapped Use Only" area.

K. 
Use of nonpermit facilities. The use of nonpermit facilities (such as the large pavilion at Indian Lake, small nonrental pavilions, open fields, etc.) shall be for the exclusive purpose of casual gathering, dining, or picnicking by park users. Private party events, i.e., weddings, showers, birthday/anniversary/graduation parties, etc., shall not be permitted as they conflict with public use of the facilities. The Township maintains the right to utilize the facilities for Township-sponsored events, or to make the facilities available to nonprofit or civic organizations for the purpose of a community event or activity upon approval of the Township Manager or the Board of Commissioners.

L. 
Alcohol permits. The Township may grant alcohol permits for registered pavilion rentals and authorized sponsored events subject to the following terms:

(1) 
Beer/wine permit: $100 permit fee; $200 refundable deposit. This fee is in addition to the pavilion rental fee.
(2) 
The permit shall be affixed to the pavilion/vendor area at all times during rental period.
(3) 
Alcohol permits shall only be issued in conjunction with park pavilion rentals or sponsored events in the parks.
(4) 
All applicants must be at least 21 years of age and be always present during the permitted rental/event.
(5) 
Beer and wine shall be the only acceptable forms of alcoholic beverages permitted.
(6) 
No glass bottles shall be permitted.
(7) 
Applicants shall be responsible for leaving the facilities in a clean and presentable condition; such condition shall be comparable to the state of the facility prior to the permitted event.
(8) 
All other facility rules shall be adhered to, including the hours of operation.
(9) 
The applicant must execute a hold harmless agreement.
(10) 
The Township Manager has the ability to withhold all or part of the security deposit, for any violations of Article I or upon any conduct requiring police or other municipal services if such conduct can be associated with alcohol consumption, or upon the recommendation of the Director of Public Works, Director of Parks and Recreation, or the Chief of Police.
(11) 
Applicant must provide verification of age to the administration and proof of homeowner's insurance or liability policy for the event.
(12) 
Applicant must provide copy of liability insurance if alcohol is provided by a caterer at the park pavilion.
(13) 
If an event is sponsored in the parks and the sponsor has vendors that will sell alcohol, the sponsor must ensure that each vendor applies for a permit at $100, provides liability insurance naming North Huntingdon Township as an additional insured and is licensed to sell alcoholic beverages.
(14) 
Consumption of alcoholic beverages shall be limited to a twenty-foot perimeter around the rented pavilion. The park's staff shall designate an approved area for consumption of alcoholic beverages for sponsored events within the parks. At no time shall there be the consumption of alcoholic beverages outside of the designated areas.
(15) 
Alcohol applications must be submitted to the Township Manager in no less than three business days prior to permit date.
The Township Manager or written designee shall have the authority to grant permission to written requests for use of Township property and parks owned and maintained by the Township of North Huntingdon. Such permission shall be in response to a written request which will be followed by the grant or denial in writing of the request received. However, the Township Manager or designee may at any time determine that the nature of the request for permission to use Township property including parks is of such a nature that it must be sent to the Board of Commissioners for the grant of approval or denial.

A. 
Any person, firm or corporation who violates the provisions of this article shall, upon conviction, be sentenced to pay a fine of not less than $100 nor more than $1,000, plus the costs of prosecution, and, in default of the payment of the fine and costs of prosecution, shall be imprisoned for a period not exceeding 30 days. The fines and penalties may be collected by suit instituted in the name of the Township of North Huntingdon before any Magisterial District Judge in like manner as debts of like amount may be used for by existing laws.[1]

B. 
Each and every violation hereunder shall constitute a separate offense, subject to the penalties provided in the preceding Subsection A.

Areas of parks and playgrounds where children are present in the North Huntingdon Township shall be designated tobacco-free, and the use of any tobacco product or electronic cigarette, in any form, shall be prohibited hereafter.
Appropriate signage will be posted delineating the tobacco-free areas.

Violators of this article shall upon finding of violation by the Magisterial District Judge shall pay a fine or other penalty as authorized and prescribed by Section 58321-A of the First Class Township Code, 53 P.S. § 58321-A, that being a civil penalty not to exceed of $600 per violation or a criminal fine not to exceed $1,000 per violation and imprisonment to the extent allowed by law for the punishment of a summary offense.
The community shall be notified of this article.
As used in this article, the following terms shall have the meaning indicated:
TOBACCO PRODUCT
Includes:
A. 
Any product containing, made, or derived from tobacco or nicotine that is intended for human consumption, whether smoked, heated, chewed, absorbed, dissolved, inhaled, snorted, sniffed, or ingested by any other means, including but not limited to cigarettes, cigars, little cigars, chewing tobacco, pipe tobacco, snuff; and
B. 
Any electronic device that delivers nicotine or other substances to the person inhaling from the device, including but not limited to an electronic cigarette, cigar, pipe, or hookah.
C. 
Notwithstanding any provision of Subsections A and B to the contrary, "tobacco product" includes any component, part, or accessory of a tobacco product, whether or not sold separately. "Tobacco product" does not include any product that has been approved by the United States Food and Drug Administration for sale as a tobacco cessation product or for other therapeutic purposes where such product is marketed and sold for such an approved purpose.
All ordinances or parts of ordinances which are inconsistent herewith are hereby repealed.
If any sentence, clause, section, or part of this article is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality, or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this article. It is hereby declared as the intent of the Township Commissioner that this article would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein.
