There is hereby created and established a new updated Recreation Board which replaces the former Recreation Board of the Township of North Huntingdon.
A. 
The Recreation Board shall be composed of seven members; each member shall be a resident of the Township and shall be appointed by the Board of Commissioners of the Township of North Huntingdon. Two of the seven members are nominated by the Norwin School Board.[1]

B. 
The Recreation Board shall have the duty and responsibility: to advise, to make suggestions or recommendations and to otherwise assist the Board of Commissioners of the Township of North Huntingdon on matters concerning and related to the provision, conduct, maintenance, operation, supervision and development of recreational programs, all public parks, playfields, and ball fields, and all outdoor and indoor public recreational areas, facilities, and centers owned and controlled by, and within, the Township of North Huntingdon; to make recommendations for basic policy with respect to the parks, playfields, ball fields, recreational programs and recreational areas, facilities and centers of the Township; to recommend long-range plans for the acquisition of real and personal property for parks and recreational purposes; and to make recommendations upon any proposed sale, purchase or lease of real or personal property of the Township relating to parks, playgrounds and recreational purposes.
C. 
The Recreation Board's duties and responsibilities are of a purely advisory nature. It is expected that the Recreation Board will advise or otherwise assist the Board of Commissioners when called upon to do so. However, the Recreation Board is not granted or endowed with any power, right or authority to expend, appropriate, raise, levy or collect any Township monies, funds, property or revenue. The Recreation Board is not granted or endowed with any power, right or authority over or regarding any Township budgetary, spending, treasury or taxation matters. The Recreation Board is not a "park board" or "recreation board" as defined and intended under 53 P.S. § 58001 et seq.
D. 
Subject to the exceptions listed below in Subsection E, the Recreation Board shall have no authority to enter into any contract(s) or to incur any obligation(s) binding upon the Township of North Huntingdon; nor shall it have the authority, ability, power or right to hire, discharge, promote, demote, remove, advance or otherwise affect the employment of any employee, agent or servant of the Township; to rent, lease or otherwise acquire, obtain or procure property whether real or personal; to buy, purchase or otherwise acquire, obtain or procure property whether real or personal; to rent, lease, buy, purchase or otherwise acquire, obtain or procure goods or services; to rent, lease, grant, convey, sell, donate, give away, relinquish, abandon or otherwise dispose of Township property whether real or personal; to mortgage, borrow against, offer as security or collateral, pledge or otherwise encumber Township property whether real or personal; or to levy, charge or collect any fees or charges.
E. 
The Recreation Board may accept any grant, conveyance, transfer, bequest, gift or donation of services, money, real property or personal property, whether tangible or intangible, from any individual or group, only upon approval of and only through the Board of Commissioners of the Township of North Huntingdon. Such services, money or property are/is to be used as specified by the donor, grantor or transferor, or by the terms of acceptance. Money received by the Recreation Board, and as approved by the Board of Commissioners of the Township of North Huntingdon, which is received without uses or terms specified by the donor, grantor or transferor or without terms of acceptance, shall be deposited by the Township into the Treasury of the Township to the credit of and for uses furthering general recreational purposes.
F. 
The Recreation Board members shall serve for a term of five years. All terms shall expire on December 31 of the appropriate year. All members shall serve until their respective successors are appointed. Those members initially appointed to the Recreation Board shall be appointed so that the term of one member shall expire annually thereafter and so that no more than two members' terms expire in the same year.[2]

G. 
Vacancies shall be filled for the unexpired term only.
H. 
Members of the Recreation Board shall serve without pay.
The Recreation Board may elect from its membership a Chairman, a Secretary and such other officers as it may deem necessary for the orderly procedure of its business. The officers elected under this section shall serve for a term of one year in office or until successors are elected. The Recreation Board may adopt bylaws, rules and regulations related to its procedures and which are not inconsistent with the provisions of state, federal, county, Township or any other applicable laws, rules and regulations. The Recreation Board shall hold regular meetings at such times and in such places as it may designate.
The Recreation Board shall make a full and complete annual report to the Board of Commissioners of the Township of North Huntingdon. The Recreation Board shall make all other reports at such times as may be designated or requested by the Board of Commissioners of the Township of North Huntingdon.
The powers as are now or that may hereafter be provided by statute of the Commonwealth of Pennsylvania or by any ordinance of the Township of North Huntingdon relating to the development and operation of recreation systems, programs, areas, facilities, centers, public parks, playfields, ball fields and playgrounds are hereby vested in the Board of Commissioners of the Township of North Huntingdon. The Recreation Board shall exercise only those powers and responsibilities granted to it by said Board of Commissioners through motions, resolutions or ordinances. The Board of Commissioners specifically retains the power to itself to hire and discharge any Director of Recreation and further retains the right to approve all other hirings and discharges of personnel.
The Board of Commissioners of the Township of North Huntingdon hereby expressly provides that, to the extent deemed necessary or applicable, this chapter may be amended from time to time by future ordinances modifying the contents of this chapter or, when dealing with purely administrative matters, by resolutions and motions of the Board of Commissioners.
