As used in this chapter, the following terms shall have the
meanings indicated:
AUTOCAB
Any automobile with a capacity of no more than 14 passengers
(not including the driver) or stretched not more than four passenger
seats more than originally manufactured, used in the business of carrying
passengers for hire which is held out, announced or advertised to
operate or run or which is operated or run over any of the streets
or public highways of the state, and which is hired by the charter
or for a particular contract, or by the day or hour or either fixed
period, or to transport passengers to a specified place or places,
or which charges a fare or price agreed upon in advance between the
operator and the passenger. Nothing in this section shall be construed
to include taxicabs, hotel buses or buses employed solely in transporting
school children or teachers or autobuses which are subject to the
jurisdiction of the Board of Public Utilities, or interstate autobuses
required by federal or state law or rules of the Board of Public Utilities
to carry insurance against loss from liability by law on account of
bodily injury or death.
STREET
Any street, avenue, park, parkway, highway, or other public
place.
No person or entity shall operate a limousine business or limousine
service with its principal place of business within the Borough without
applying for and obtaining a license for that business or service,
and complying with the terms of N.J.S.A. 48:16-3 et seq. [excluding
48:16-3 (b)]. No person or entity shall operate such a business/service
without a current license in place.
Any person or entity proposing to operate a limousine business
or service with its principal place of business within the Borough
shall annually apply to the Borough Clerk for a limousine license.
That application and submission shall include but not be limited to
the following requirements and information:
A. A complete listing, including make, license number and VIN number,
of all vehicles to be used in the limousine business/service, including
proof of ownership and registration. If the vehicle is leased, a true
copy of the lease must be supplied.
B. A copy of a certificate of insurance indicating the statutory minimum
liability coverage.
C. A complete and detailed description of the place and location where
the limousine business/service shall be operated, the number of employees
working on site, the approximate number of drivers operating vehicles
and the location where vehicles are parked daily and overnight.
D. The names, residence and business addresses of the owners/principal
operators of the business/service.
E. An executed power of attorney wherein the owner appoints the Chief
Financial Officer of the Borough for purposes of acknowledging service
of process from any court of competent jurisdiction.
F. Any other information or documentation deemed appropriate or necessary
by the Borough Clerk and/or the Police Department.
Each applicant shall be charged the fee of $25 per limousine for a certification issued pursuant to §
154-3 of this chapter.
