This chapter shall hereafter be known and cited as the "Tattoo,
Body Piercing, Branding, and Scarification Regulations."
As used in this chapter, the following words shall have the
following respective meanings:
ANTIBACTERIAL SOLUTION
Any solution used to retard the growth of bacteria approved
for application to human skin and includes all products labeled accordingly.
BLOOD-BORNE PATHOGENS
Pathogenic microorganisms that are present in human blood
which can cause disease in humans. These pathogens include, but are
not limited to, the following:
BODY PIERCING
The piercing of any part of the body, except the ear or nose
(cartilage piercing).
BRANDING
The use of heat, cold or any chemical compound to imprint
permanent markings on human skin by any means other than tattooing.
CLEANED
The removal of all visible dust, soil, or any other foreign
material.
MINOR
Any person under the age of 18 years of age.
OPERATOR
The partnership, the corporation, the association, or the
person or group of persons who maintain and control the tattoo/body
piercing studio and who are legally responsible for the operation
of the studio.
OTHER POTENTIALLY INFECTIOUS MATERIALS (OPIM)
The following:

Human body fluids as follows:

Saliva in dental procedures.
(10)
Any body fluid that is visibly contaminated with blood.
(11)
All body fluids where it is difficult or impossible to differentiate
between body fluids.
(12)
Any unfixed tissue or organ, other than intact skin, from a
human, living or dead.
B.
HIV-containing cell or tissue cultures, and HIV- or HBV-containing
culture medium or other solutions; and blood, organs, or other tissues
from experimental animals infected with HIV or HBV.
PERMIT
The authorization granted by the Village to operate a tattoo/body
piercing studio.
SANITARY
Clean and free of agents of infection or disease.
SANITIZED
Effective antibacterial treatment by a process that provides
sufficient concentration of chemicals for enough time to reduce the
bacteria count including pathogens to a safe level on equipment.
SCARIFICATION
The cutting or tearing of human skin for the purpose of creating
a permanent mark or design on the skin.
STERILIZATION
Holding an instrument in an autoclave for required length
of time at 15 to 30 pounds pressure at a temperature of 249.8°
F. or 121° C.
TATTOO
A mark on the body of a person made with indelible ink or
pigments injected beneath an outer layer of the skin.
TATTOO ARTIST
Any person who applies a tattoo to the body of any other
person.
TATTOO STUDIO
Any premises in which the tattoo artist conducts such practice.
No person, firm, corporation, partnership, or other association
shall operate a body piercing studio or tattoo studio within the Village
of Central Square without first obtaining a license from the Village
of Central Square Board of Trustees as provided herein. No person
shall operate as a body piercing specialist within the Village of
Central Square unless employed by a licensed body piercing studio.
No person shall operate as a tattoo artist within the Village of Central
Square unless employed by a licensed tattoo studio.
A body piercing studio or tattoo studio license may not be granted
to an owner or operator convicted of any felony, any offense relating
to fraud of any sort, or any violations of OHSA health regulations.
In the event a license under this chapter is granted at any
time after June 1 of any year, the amount of such license fee shall
be decreased proportionately to the remaining months of the license
year.
Such license, once issued, shall not be transferable and each
new owner or proprietor shall be required to be licensed. A license
shall no longer be valid and shall be returned to the Village when
the studio ceases to operate, has moved to another location, the ownership
changes, or the permit is suspended or revoked.
Every body piercing studio or tattoo studio license issued in
accordance with the provisions of this chapter shall be posted conspicuously
before the commencement of business and maintained on display in a
manner open to public view on the licensed premises.
Such license shall be renewable on June 1 of each year. To secure
renewal of such license, the licensee must make written application
in the form of a request for renewal to the Village Board of Trustees
at least 30 days before the expiration of such license. Such request
shall be accompanied by the payment of the renewal fee in the form
of cash, certified or bank check payable to the Village of Central
Square.
No owner/operator of a body piercing studio or tattoo studio
shall keep more than one house, shop or place for carrying out that
business by virtue of one license, without the written permission
of the Village Board of Trustees.
All operators are required to develop a written policy for the
handling and disposal of infectious waste.
A. Needles, razors, or other sharp instruments used during tattoo/body
piercing procedures shall be placed in puncture-resistant, closed
containers immediately after use.
B. Needles shall not be purposely bent or broken, or otherwise manipulated
by hand.
C. Containers of sharp waste shall be sent to a facility where they
are either incinerated or otherwise rendered nonhazardous in compliance
with OSHA procedures related to occupational exposure to blood-borne
pathogens.
D. Contaminated waste which may release liquid blood or body fluids
when compressed or may release dried blood or body fluids when handled
must be placed in an approved "red bag," which is marked with the
international biohazard symbol. It must then be disposed of in compliance
with OSHA procedures related to occupational exposure to blood-borne
pathogens.
E. Waste containers shall be kept closed when not in use.
F. Disposable waste shall be handled, stored, and disposed of to minimize
direct exposure of personnel to waste materials.
G. At least one covered waste receptacle shall be provided in each operator
area and each toilet room. Receptacles in the operator area shall
be emptied daily and solid waste shall be removed from the premises
at least weekly. All refuse containers shall be lidded, cleanable
and kept clean.
Any preexisting tattoo studios or body piercing studios located
within the boundaries of the Village of Central Square must apply
for a license within 60 days from the effective date of this chapter.
The Code Enforcement Officer of the Village of Central Square
and the Village Board of the Village of Central Square in its capacity
as a Village Board of Health shall be the primary enforcement agents
of this chapter.
