[HISTORY: Adopted by the Board of Supervisors of the Township of Marlborough 6-9-1997 by Ord. No. 97-1. Amendments noted where applicable.]
Pursuant to Section 2901 of the Second Class Township Code, 53 P.S. § 67901, the Board of Supervisors does hereby appoint and establish a Shade Tree Commission.
The Shade Tree Commission shall be composed of three members who shall be residents of the Township. The initial terms of members shall be for periods of three years, four years, and five years, respectively. All subsequent terms shall be for a period of five years.
The Chairman of the Shade Tree Commission shall be appointed by the Board of Supervisors.

The Shade Tree Commission shall have the following powers and duties:
A. 
To administer regulations for shade trees;
B. 
To exclusively control shade trees in the Township;
C. 
To plant, remove, maintain and protect shade trees on the public streets and highways in the Township, excluding state highways;
D. 
With the approval of the Board of Supervisors, to employ persons to perform the duties and directions of the Commission;
E. 
To make and publish regulations for the care and protection of shade trees within the Township; and
F. 
To annually report to the Board of Supervisors its transactions and authorized expenses for the preceding fiscal year of the Township.
