This chapter shall be known and may be cited as the "Marlborough Township Automatic Firearms Ordinance."
It is hereby declared to be a matter of public health and safety to regulate the firing of automatic firearms in Marlborough Township. This chapter is hereby enacted for the purpose of regulating the use of automatic firearms, and said chapter shall not be construed as a regulation of the lawful ownership, possession, transfer or transportation of any firearm, ammunition or ammunition component.
The following words, terms and phrases, when used in this chapter, unless the context clearly indicates otherwise, shall have the following meanings:
AUTOMATIC FIREARM
A firearm originally designed to fire, or capable of firing, more than one round with a single pull of the trigger.
FIREARM
A weapon which is designed to expel a projectile by the action of an explosive or which may be readily converted to do so.

Any person violating any of the provisions of this chapter shall, upon conviction therefor before a Magisterial District Judge in a summary proceeding, be sentenced to pay a fine or penalty of not more than $1,000, plus costs, and in default of the payment of the fine and costs, the defendant may be sentenced to the county jail for a period not exceeding 90 days. Each day upon which a violation occurs; shall constitute a separate offense. This penalty section is enacted pursuant to Section 702, Clause XLI, of the Second Class Township Code, 53 P.S. § 65741, for the purpose of protecting the health and safety of the residents of Marlborough Township.
