To promote the public health, safety, morals and general welfare,
and to assist in the prevention of fires, the Plymouth Township Council
finds that it is in the best interest of the Township to prohibit
(except as provided herein) the smoking, carrying or the use of a
lighted pipe, cigar, cigarette or tobacco in any form (including chewing
tobacco) in Alan Wood Park, Bicentennial Park, Black Horse Park, Colwell
Park, Community Center Park, East Plymouth Valley Park, Harriet Wetherill
Park, John F. Kennedy Park, Plymouth Hills Park, Plymouth Meeting
Park, Sandwood Park, the Greater Plymouth Community Center located
at 2910 Jolly Road, Plymouth Meeting, Pennsylvania, and the Township
property located at 700 Belvoir Road, Plymouth Meeting, Pennsylvania,
in Plymouth Township.

(a) In general. The smoking, carrying or the use of a lighted pipe, cigar,
cigarette or tobacco in any form (including chewing tobacco) is prohibited
in the areas herein provided.
(b) Prohibited areas. Smoking, carrying or the use of a lighted pipe,
cigar, cigarette or tobacco in any form (including chewing tobacco)
shall be prohibited in Alan Wood Park, Bicentennial Park, Black Horse
Park, Colwell Park, Community Center Park, East Plymouth Valley Park,
Harriet Wetherill Park, John F. Kennedy Park, Plymouth Hills Park,
Plymouth Meeting Park, Sandwood Park and the Greater Plymouth Community
Center located at 2910 Jolly Road, Plymouth Meeting, Pennsylvania,
and the Township property located at 700 Belvoir Road, Plymouth Meeting,
Pennsylvania; provided, however, specifically designated smoking areas
marked with signs stating "Smoking Permitted" maybe designated by
the Fire Official on the grounds of the Greater Plymouth Community
Center located at 2910 Jolly Road, Plymouth Meeting, Pennsylvania,
and on the grounds of the Township property located at 700 Belvoir
Road, Plymouth Meeting, Pennsylvania.
(c) "No Smoking" and/or "No Tobacco Products" signs. The Fire Official
is empowered and authorized to post "NO SMOKING" and/or "NO TOBACCO
PRODUCTS" signs in the parks and buildings where the smoking, carrying
or use of a lighted pipe, cigar, cigarette or tobacco in any form
(including chewing tobacco) are prohibited. The content, lettering,
size, color and location of such signs shall be subject to the approval
of the Fire Official.
(d) Removal of signs prohibited. It shall be unlawful for any person
to obscure, remove, deface, mutilate or destroy a posted "NO SMOKING"
and/or "NO TOBACCO PRODUCTS" sign.
(e) Compliance with "No Smoking" and "No Tobacco Products" signs. It
shall be unlawful for any person to smoke, throw or deposit any lighted
or smoldering substance or to chew tobacco where smoking or chewing
tobacco is prohibited.
(f) Ash trays. Where smoking is permitted, there shall be provided at
such locations suitable noncombustible ash trays or match receivers.

Any person violating this division or any section thereof shall
be guilty of a summary offense and, upon conviction before a District
Justice, shall be subject to a fine of not less than fifty dollars
($50.00) nor more than one thousand dollars ($1,000.00); or, in default
thereof, to imprisonment not to exceed thirty days.
