The Administrative Service of the municipality shall be under the direction of the Manager and be comprised of the following departments and heads thereof and such other departments and heads as may be created by amendments to this Administrative Code:
Administration, including:
Municipal Manager
Engineering
Finance
Personnel
Purchasing
Public safety, including police
Chief
Planning and land use, including zoning
Land Use Administrator
Planning and Code Enforcement
Information technology
Director
Community services, including:
Director
Parks and recreation, public works
Environmental services
Director
All department heads shall be appointed, promoted, demoted, suspended or removed by the Manager, except as otherwise provided by law or the Charter, in accordance with the Personnel Code and with approval of Council.
Department heads, when directed by the Manager, shall:
A. 
Direct personally and through subordinates the performance of all functions, duties and operations assigned to and required of the department and its subordinate units by law, the Charter, or ordinance and such other activities as may be required by the Manager that are not in conflict with law, the Charter, or ordinance;
B. 
Develop and prescribe the internal organization of the department and its subordinate units, subject to the approval of the Manager, and in accordance with applicable provisions of law, the Charter, or ordinance;
C. 
Assign duties and responsibilities to subordinates within the department and modify those assignments consistent with and in response to the changing exigencies of service, subject to the approval of the Manager;
D. 
Prepare and submit departmental budget requests in accordance with schedules, forms, and policies as prescribed by the Manager;
E. 
Prepare and submit at least monthly regular reports prescribed by the Manager;
F. 
Cooperate with and furnish to any department or unit of the municipality any information, service, labor, material or equipment that may be necessary to perform a municipal function;
G. 
Be aware of and coordinate the activities of the department with appropriate areawide, regional and intergovernmental programs; keep the Manager informed of the activities and policies of such programs as they affect the department or the municipality; and make analyses and recommendations regarding such activities and policies when appropriate;
H. 
Administer and evaluate intergovernmental contracts and agreements as these relate to departmental functions;
I. 
Develop and maintain internal administrative and budgetary controls and productivity and performance standards to assure maximum levels of quality and quantity of service within budgetary limitations;
J. 
Remain up-to-date with developments regarding administrative policies, management techniques, technological advances and make recommendations to the Manager concerning possible action to be taken by Council, as needed;
K. 
Keep abreast of all laws. Municipal ordinances and administrative regulations relating to the functions of the department;
L. 
Serve as a member of any committee or provide staff services to any authority, board or commission to which the department head may be assigned by the Manager;
M. 
Develop personnel planning and employee development policies for the department, including the planning and execution of appropriate training and education programs;
N. 
Establish and enforce rules and regulations for the use of municipal facilities and services and issue such licenses and permits as may be required by ordinance;
O. 
Develop and recommend to the Manager rate structures for those services for which user fees are charged.
A. 
Function. The Department of Administration shall be responsible for performing staff functions for Council as well as assisting departments and other units of the municipality in carrying out their duties.
B. 
Department head. The Department of Administration shall be headed by the Municipal Manager.
C. 
Duties. The duties of the Manager, as the head of the Department of Administration, shall be to:
(1) 
Develop a Personnel Code for approval by Council.
(2) 
Administer the personnel system of the municipality subject to the provisions of law, the Charter, the Personnel Code, and policies established by Council, including such matters as:
(a) 
Recruiting and selecting persons for municipal employment as determined by the Personnel Code;
(b) 
Developing and maintaining the position classification and pay plans;
(c) 
Participating in and administering labor relations programs including contract negotiations, contract administration and related programs;
(d) 
Developing and maintaining personnel rules and regulations;
(e) 
Assisting departments in developing and conducting employee training and development programs;
(f) 
Assisting departments in preparing personnel planning programs; and
(g) 
Developing and maintaining records reflecting all aspects of municipal employees.
(3) 
Provide, together with the Controller, assistance in the development of operating budgets, long-term fiscal programs and related budgetary and administrative analyses, including:
(a) 
Developing a budget calendar, forms and procedures subject to the provisions of law, the Charter or ordinance;
(b) 
Participating in budget analyses and hearings relative to budget requests, budget amendments and budget allocations;
(c) 
Maintaining budget expenditure control during the course of the fiscal year and keeping Council informed on the progress and development of plans, policies and programs as they relate to the budget;
(d) 
Reviewing, analyzing and making improvements in the administrative organization and procedures throughout the municipality;
(e) 
Assisting departments and other units of the municipality in the development of administrative manuals and in the solution of administrative and organizational problems; and
(f) 
Performing such research and studies as Council may direct.
(4) 
Be responsible for the administration of activities pertaining to the receipt, expenditure, accounting, investment, custody and control of municipal funds and assets, except to the extent that such activities are expressly charged by law, the Charter or ordinance to the Controller or Legal Counsel.
(a) 
Maintain a uniform accounting system in accordance with generally accepted principles of governmental accounting, which involves keeping a full and regular set of fiscal records, in detail by double entry, of all fiscal operations of the municipality; keeping a separate account for each item of appropriation made by Council, showing the amount of the appropriation, any allotments of that appropriation, the amounts paid from it, the unpaid obligations against it and the unencumbered balance of the appropriation and any allotments thereof; keeping a current statement of indebtedness; and requesting all municipal departments, offices and agencies to report and remit all receipts as often as deemed desirable;
(b) 
Preaudit fiscal transactions of all municipal units in accordance with generally accepted principles of governmental auditing;
(c) 
Disburse all payments for authorized expenditures, which must be done only with checks or drafts signed by the Manager, Controller and a member of Council. In the absence of the Manager and/or the Controller, additional members of Council shall sign checks or drafts;
(d) 
Deposit monies in depositories authorized by resolution;
(e) 
Provide for the prudent investment of monies;
(f) 
Provide custody of fidelity bonds of officers and employees, except his or her own, which shall be in the custody of the Controller, and provide custody of all deeds, mortgages, contracts, judgments, notes, debts, securities, bonds, insurance policies and other forms of negotiable instruments owned by the municipality; and
(g) 
Supervise the lease, rental, sale or other use or disposition of property no longer required by any municipal unit.
(5) 
Be responsible for public safety and protection of persons and property within the municipality.
(6) 
Administer the purchasing system subject to the provisions of law, the Charter or ordinance, and specifically the ordinance concerning procedures for the procurement of goods and services, including such matters as:
(a) 
Preparing and evaluating standards and specifications for materials, services and equipment;
(b) 
Purchasing materials, services and equipment for the municipality;
(c) 
Storing materials and equipment not delivered directly to the departments and other units of the municipality;
(d) 
Maintaining an inventory control system for all real and personal property;
(e) 
Determining whether materials, services and equipment purchased meet specifications;
(f) 
Evaluating and managing all insurance contracts including fidelity bonds to insure the lowest possible cost to the municipality, while obtaining the most responsible providers;
(g) 
Negotiating total cost purchasing contracts covering initial purchase, maintenance and repurchase whenever possible to insure the lowest possible cost to the municipality, while obtaining the most responsible providers.
(7) 
Provide for the engineering services of the municipality, utilizing the services of the Municipal Engineer(s) appointed by Council.
A. 
Function. The Department of Public Safety shall be responsible for the protection of persons and property within the municipality and the enforcement of applicable laws, ordinances, codes and regulations.
B. 
Department head. The Department of Public Safety shall be headed by a Chief who shall be responsible to the Manager for the performance of the functions of the department.
C. 
Duties. The duties of the Chief shall be to:
(1) 
Provide police protection services to:
(a) 
Prevent crimes against persons and property;
(b) 
Enforce all criminal laws and ordinances;
(c) 
Detect and apprehend offenders and suspected persons;
(d) 
Maintain records and files of crimes and criminals;
(e) 
Develop and conduct community relations and education programs.
(2) 
Coordinate and cooperate with the Director of Community Services, where appropriate, in the specification, procurement, installation and maintenance of traffic control devices and directional signs and signals.
(3) 
Coordinate and cooperate with the Volunteer Fire Departments and Emergency Medical Services, where appropriate, concerning matters of public safety.
(4) 
Provide communication system services by:
(a) 
Assuring the operation and maintenance of such radio and other emergency communication systems as may be assigned to the Department; and
(b) 
Maintaining records and/or logs relating to radio and emergency communication systems as required by law.
A. 
Function. The Department of Community Services shall be responsible for the maintenance, construction and operation of those physical structures (roads, bridges, storm sewers, buildings, signs, etc.) and park facilities (baseball fields, outdoor swimming pool, etc.) that are owned by the municipality. The Department shall also be responsible for developing, operating and supervising recreation programs.
B. 
Department head. The Department of Community Services shall be headed by a Director who shall be responsible to the Manager for the performance of the functions of the Department.
C. 
Duties. The duties of the Director shall be to:
(1) 
Construct and maintain the streets, bridges, curbs and gutters of the municipality, including the provision of street cleaning, snow removal and ice control services;
(2) 
Construct and maintain storm sewer structures, facilities and appurtenances;
(3) 
Provide for installation and maintenance of traffic control devices, directional signs and signals, and street name signs;
(4) 
As appropriate, clear or plant and maintain trees and other vegetation along municipal rights-of-way and other property of the municipality;
(5) 
Plan, develop, design and administer, in cooperation with the appropriate municipal departments, municipal park and recreation facilities owned, acquired or designed by the municipality or the Hampton Township School District;
(6) 
Organize, equip, staff and conduct recreation programs for citizens of the municipality;
(7) 
Maintain and supervise custodial services for those buildings owned by the municipality exclusive of the Water Pollution Control (Sewer) Plant;
(8) 
Coordinate the repair and maintenance of all municipal owned vehicles;
(9) 
Plan, develop, design and administer in cooperation with other appropriate departments and agencies of other governments, expansion and modification of facilities for which the Department is responsible.
A. 
Function. The Department of Planning and Land Use shall be responsible for the development and enforcement of land use (zoning) regulations as well as the review of land use development plans.
B. 
Department head. The Department of Planning and Land Use shall be headed by the Land Use Administrator, who shall be responsible to the Manager for the performance of the functions of the Department.
C. 
Duties. The Land Use Administrator shall be responsible for the following duties:
(1) 
Coordinate short- and long-range planning and community development programs for the municipality, including:
(a) 
Preparation, review and maintenance of the Comprehensive Plan and zoning regulations of the municipality, including data collection, mapping and analysis as needed;
(b) 
Service as secretariat to the Planning Commission and Environmental Advisory Council as well as review and coordinate the land use application process;
(c) 
Perform the various duties and exercise various powers as prescribed by law, and specifically, the Pennsylvania Municipalities Planning Code;[1]

(d) 
Prepare, review and maintain plans for human services including health care, education, employment, recreation and other social services and coordinate such plans with those addressing the physical and economic development of the municipality.
(2) 
Be responsible for the protection of persons and property within the municipality through:
(a) 
Enforcement of zoning, grading, subdivision, building, electrical, plumbing, heating, housing, demolition and other such related structural and land use codes as may be enacted by law or ordinance;
(b) 
Issuance of such licenses and/or permits as may be required by law or ordinance; and
(c) 
Service as secretariat to the Zoning Hearing Board.
A. 
Function. The Department of Information Technology shall be responsible for the purchase, maintenance, and operation of the Township's electronic communications equipment and systems.
B. 
Department head. The Department of Information Technology shall be headed by a Director, who shall be responsible to the Manager for the performance functions of the Department.
C. 
Duties. The duties of the Director, as head of the Department of Information Technology, shall be:
(1) 
Manage and or supervise information technology operations; plan and organize workload and assignments;
(2) 
Perform systems support functions, software hardware upgrades, and systems programming;
(3) 
Evaluate various computer applications and software packages and make recommendations as needed;
(4) 
Manage area of responsibility in strict accordance with applicable laws, regulations and established policies;
(5) 
Develop and maintain systems documentation.

A. 
Function. The Department of Environmental Services shall be responsible for the construction, maintenance, and operation of those facilities and pipelines that carry wastewater for treatment as well as the Township Water Pollution Control Plant.
B. 
Department head. The Department of Environmental Services shall be headed by a Director who shall be responsible to the Manager for the performance functions of the Department.
C. 
Duties. The duties of the Director shall be to:
(1) 
Coordinate the day-to-day operations of the Township sanitary sewer collection system and Water Pollution Control Plant;
(2) 
Assist in the planning and design of the sanitary sewer collection system;
(3) 
Work with engineering with regard to the operational design of the Water Pollution Control Plant;
(4) 
Oversee the collection records, maps and data relating to the administration management of the Department;
(5) 
To ensure compliance with all county, state, federal and local laws and or regulations governing the collection and transport as well as treatment of wastewater; and
(6) 
Plan, develop, design and administer in cooperation with other departments and agencies of other governments, expansions, modifications, additions or deletions of facilities and programs for which the Department is responsible.
The Municipal Manager shall be responsible for the collection of real estate taxes levied by the Council. The duties of the Manager in this regard shall be those established by law and the Charter and shall include, but not be limited to the following:
A. 
The diligent collection of the taxes levied by Council.
B. 
Keeping clear and detailed accounts of all sums received from taxes and other sources, which accounts shall at all times be open to inspection by Council Members, the Controller and the appointed independent Auditor.
C. 
All municipal monies collected from all sources shall be promptly deposited in a bank, trust company or other institution designated by the municipality in an account in the name of the municipality.
D. 
The Manager shall collect and receive for the Township Treasury all taxes, fees, assessments or charges that are levied or established by the Township, for general or special purposes, unless Council shall designate another person or agency to collect such taxes. If a school district or other taxing body empowered to collect taxes within the Township shall enter into an Agreement with the Township for said taxes, the Manager shall collect such taxes unless Council shall designate another person or agency. The Manager shall receive no special compensation as Tax Collector, and any payments by a school district or other taxing body for collection of taxes shall accrue to the Township and not to the Manager. Any such agreement relating to compensation for the collection of taxes with the school district or with any other taxing body shall be negotiated by the Township Council, and shall be designated by ordinance or resolution. Existing agreements with the school district or other taxing bodies shall continue in place, substituting therefor the Manager in place of the Tax Collector; all such agencies or taxing bodies shall be given notice of the substitution of the Manager and shall be required to send in writing its consent to such substitution. The Township shall require that the Manager provide a bond for the collection of taxes, as is required under the laws of the Commonwealth of Pennsylvania, relating to the collection of taxes.
A. 
Function and duties. The Controller shall be responsible for exercising overall review and control of the finances of the municipality. The duties of the Controller shall be those established by law, the Charter and the Administrative Code. Subject to the policies and limitations established by Council, a Controller's duty shall be to review investments and fiscal affairs of the municipality, authorize payments and expenditures only for duly and lawful purposes, suggest plans to Council for the management and improvement of the municipality's finances, and to do all other acts authorized by law or this Charter, and to report to Council on any and all such reviews or actions taken by him.
B. 
Powers.
(1) 
The Controller shall have the authority to exercise the control of the management of the finances of the municipality as set forth in the Charter and this chapter. The powers of auditor under general law shall be vested in the Controller.
(2) 
The Controller shall have the authority to administer oaths and issue subpoenas incidental to the authentication of any municipal account or of any claim or demand against the municipality.
The Legal Counsel shall be responsible for advising Council, the Manager, or any official, official body, or agency of the municipality upon all legal questions arising in the conduct of municipal business, unless Special Counsel is appointed. The Legal Counsel shall also:
A. 
Prepare and revise ordinances or resolutions when so requested by Council or the Manager;
B. 
Provide written legal opinions upon any legal matter or question affecting the municipality submitted by Council or the Manager. Requests for legal opinions from other officials, official bodies or agencies of the municipality shall be made through the Manager;
C. 
Attend all regularly scheduled meetings of Council;
D. 
Litigate all legal actions and claims brought by or against the municipality except in those cases in which other legal counsel is retained; and
E. 
Approve for legality all contracts, agreements or other legal documents to be executed by authorized municipal officials.
A. 
Appointment and scope of authority.
(1) 
Council may appoint one or more engineers, on a full-time or part-time or retainer basis, for an indefinite term. The Engineer shall be an official of the municipality and shall hold office until his appointment is terminated by the Council.
(2) 
All of the engineering affairs of the municipality shall be under the general supervision of the Engineer. Except as otherwise provided by the General Assembly, no official, official body or agency of the municipality may employ an additional engineer without express authorization to do so from Council.
B. 
Duties. The Engineer shall render such engineering services as may be necessary or desirable for the best interests of the municipality, and shall, upon request, furnish Council or any official, official body or agency of the municipality with a written report or estimate upon any question of an engineering nature submitted by any of them in their official capacity. Except for requests from Council, all requests for engineering services shall be made through the Manager.
