This Home Rule Charter shall apply to the municipality previously
known as the Township of Hampton, Allegheny County, Pennsylvania,
and shall be referred to herein as the "Charter."
The name of this home rule municipality, herein referred to
as the "municipality" shall continue to be the "Township of Hampton."
The boundaries of the municipality shall be the boundaries of
the Township of Hampton at the time when this Charter takes effect
and as they may be lawfully changed.
This Charter shall become effective on the first Monday of January
1982, and the government of the municipality shall operate under the
terms and provisions hereof from and after the said effective date.
It is the express intent of the electors of this municipality,
as evidenced by the adoption of this Charter to: (i) repeal the existing
form of government in any event; (ii) adopt this Charter on the effective
date stated; and (iii) if this Charter cannot become effective on
the effective date, then to adopt the Second Class Township form of
government, as soon as it can become legally effective. Therefore,
if the provisions of this Charter relating to the effective date are
held by any court of competent jurisdiction to be invalid, such invalidity:
(1) shall not affect the repeal of the existing form of government
for the Township of Hampton known as Optional Plan C; (2) shall void
all other provisions of this Charter; and (3) shall cause the form
of government of the Township of Hampton to revert to that of Second
Class Township.
