(a) Purpose and policy. This article sets forth uniform requirements
for direct and indirect contributors into the wastewater collection
system of Plymouth Township to effect compliance with applicable state
and federal laws required by the Clean Water Act of 1977 and the General
Pretreatment Regulations (40 CFR Part 403).
(b) Objectives.
(1) To prevent the introduction of pollutants into the municipal wastewater
system which will interfere with the operation of the system or contaminate
the resulting sludge at the POTW(S) servicing the Township.
(2) To prevent the introduction of pollutants into the municipal wastewater
system which will be inadequately treated and thus pass through the
system into receiving waters or the atmosphere or otherwise be incompatible
with the system.
(3) To improve the opportunity to recycle and reclaim wastewater and
sludges from the system.
(4) To provide for equitable distribution of the cost for the implementation
of the authority's municipal industrial pretreatment program.
(c) Provisions for direct and indirect contributors, authorization for
monitoring and enforcement activities, setting of fees, etc. This
article provides for the regulation of direct and indirect contributors
to the municipal wastewater system through the issuance of permits
to certain nondomestic users and through enforcement of general requirements
for the other users; authorizes monitoring and enforcement activities;
requires user reporting; assumes that an existing customer's
capacity will not be preempted, and provides for the setting of fees
for the equitable distribution of costs resulting from the program
established herein.
(d) Application of article. This article shall apply to the Township
and to persons outside the Township who are users or significant users
of the Township collection system. Except as otherwise provided herein,
the MIPP coordinator shall administer, implement and enforce the provisions
of this article.
(e) Agreements to accept wastes of unusual strength. Nothing contained
in this article shall be construed as preventing any special agreement
or arrangement between the control authority and users or significant
users within or out of the Township, whereby a waste of unusual strength
or character may be accepted by the control authority by special agreements
in writing, executed prior to such acceptance, containing safeguards,
limitations and conditions acceptable to the control authority, as
long as such wastes do not violate any applicable federal categorical
pretreatment standards or requirements.
(f) Exceptions to biochemical oxygen demand (BOD), ammonia and suspended
solids (SS) limitations. The MIPP Coordinator may grant exceptions
to the BOD, ammonia and suspended solids limitations on its own authority
based on the request in writing by any Class I industrial user (significant
user) in the event the Class I user is unable to adhere to the general
limitations set forth herein. The grant of any exception to such limitations
under this paragraph is solely within the discretion of MIPP Coordinator
and shall be granted subject to the general terms of the permit. The
MIPP Coordinator shall make its determination whether to grant an
exception to the BOD, ammonia and suspended solids limitations on
a case-by-case basis, taking into consideration the impact on the
operation of the POTW treatment plant and its ability to operate within
the standards established by the control authority's NPDES permit.
The basis for this determination shall be in accordance with the compatible
pollutant local limits reallocation study prepared from time to time
by the control authority's consulting engineers. Any party who
is aggrieved from the decision of the MIPP Coordinator regarding the
MIPP's decision regarding its request for an exception to the
aforementioned limitations may avail itself of the appeal procedure
under Sec. 25, Show cause of hearing.

Unless the context specifically indicates otherwise, the following
terms and phrases, as used in this article, shall have the meanings
hereinafter designated:
ACT or THE ACT
The Federal Water Pollution Control Act, also known as the
Clean Water Act, as amended, 33 USC 1251 et seq.
AUTHORIZED REPRESENTATIVE OF INDUSTRIAL USER
An authorized representative of an industrial user may be:
(1)
A principal executive officer of at least the level of vice-president,
if the industrial user is a corporation;
(2)
A general partner or proprietor, if the industrial user is a
partnership or proprietorship, respectively;
(3)
A duly authorized official or representative, if the industrial
user is a governmental entity;
(4)
A duly authorized representative of the individual designated
above, if such representative is responsible for the overall operation
of the facilities from which the indirect discharge originates.
BIOCHEMICAL OXYGEN DEMAND (BOD)
The quantity of oxygen utilized in the biochemical oxidation
of organic matter under standard laboratory procedure, five (5) days
at twenty (20) degrees centigrade, expressed in terms of weight and
concentration [milligrams per liter (mg/l)].
BUILDING SEWER
A sewer conveying wastewater from the premises of a user
to the POTW.
CLASS I INDUSTRIAL USER
Any industrial user discharging industrial process wastewater
where either:
(1)
The volume exceeds 10,000 gallons per day; or
(2)
The amount of BOD or suspended solids in the discharge exceeds
the mass equivalent of 10,000 gallons per day of domestic waste; or
(3)
The industrial user is subject to federal categorical standards;
or
(4)
The industrial user's discharge is determined by the MIPP
coordinator to be of such character as to require the regulation of
that discharge to protect the public interest.
CLASS II INDUSTRIAL USER
Any industrial user who discharges nondomestic wastewater
into the wastewater collection system which is regulated by means
of an industrial discharge permit.
CONTROL AUTHORITY
The term "control authority" or "authority" shall refer to
the Borough of Conshohocken Authority.
COOLING WATER
The water discharged from any use, such as air conditioning,
cooling or refrigeration, or to which the only pollutant added is
heat.
COUNCIL
The Council of Plymouth Township.
DIRECT DISCHARGE
The discharge of treated or untreated wastewater directly
to the waters of the Commonwealth of Pennsylvania.

ENVIRONMENTAL PROTECTION AGENCY (EPA)
The U.S. Environmental Protection Agency or, where appropriate,
the term may also be used as a designation for the administrator or
other duly authorized official of such agency.
GRAB SAMPLE
A sample which is taken from a waste stream on a one-time
basis with no regard to the flow in the waste stream and without consideration
of time.
HOLDING TANK WASTE
Any waste from holding tanks, such as vessels, chemical toilets,
campers, trailers, septic tanks and vacuum-pump tank trucks.
INDIRECT DISCHARGE
The discharge or the introduction of pollutants from any
nondomestic source as outlined in 40 CFR 403.3(g) and section 307(b),
(c) and (d) of the Clean Water Act of 1977, as amended.
INTERFERENCE
The inhibition or disruption of the POTW treatment processes
which contributes to a violation of any requirement of the receiving
treatment facility's NPDES permit. The term includes "sludge
process," as defined in the federal regulations, prevention of sewage
sludge use or disposal by the receiving treatment facility in accordance
with section 405 of the Act (33 USC 1345), or any criteria, guidelines
or regulations developed pursuant to the Solid Waste Disposal Act
(SWDA), the Clean Air Act, the Toxic Substances Control Act, or more
stringent state criteria, including those contained in any state sludge
management plan prepared pursuant to Title IV of the SWDA applicable
to the method of disposal or use employed by the receiving treatment
facility.
NEW SOURCE
Any facility from which there is or may be a discharge of
pollutants, construction of which began after the publication of the
proposed pretreatment standards pursuant to section 307(c) of the
Clean Water Act (CWA) which will apply to the facility if the standards
are promulgated, provided certain location and construction criteria
are met.
PASS-THROUGH
Any discharge which exits the POTW in quantities or concentrations
which, alone or with discharges from other sources, causes a violation
of the POTW's national pollutant discharge elimination system
(NPDES) permit.
PERSON
Any individual; partnership; copartnership; firm; company;
corporation; association; joint-stock company; trust estate; federal,
state and local government entity; any other legal entity or their
legal representatives, agents or assigns. The masculine gender shall
include the feminine, the singular shall include the plural, where
indicated by the context.
pH
The logarithm (base 10) of the reciprocal of the concentration
of hydrogen ions expressed in grams per liter of solution.
POLLUTANT
Any dredged spoil, solid waste, incinerator residue, sewage,
garbage, sewage sludge, munitions, chemical wastes, biological materials,
radioactive materials, heat, wrecked or discharged equipment, rock,
sand, cellar dirt, and industrial, municipal and agricultural waste
discharged into water.
POLLUTION
The man-made or man-induced alteration of the chemical, physical,
biological and radiological integrity of water.
PRETREATMENT or TREATMENT
The reduction of the amount of pollutants, the elimination
of pollutants, or the alteration of the nature of pollutants, or the
alteration of the nature of pollutant properties in wastewater to
a less harmful state prior to or in lieu of discharging or otherwise
introducing such pollutants into a POTW. The reduction or alteration
can be obtained by physical, chemical or biological processes, process
changes [or] other means, except as prohibited by 40 CFR section 403.6(d).
PRETREATMENT STANDARDS
Any substantive or procedural requirements related to pretreatment
other than a national pretreatment standard imposed on a significant
user.
PUBLICLY OWNED TREATMENT WORKS (POTW)
A treatment works as defined by section 212 of the Act (33
USC 1292). This definition includes any sewers that convey wastewater
to a POTW treatment plant, but does not include pipes, sewers or other
conveyances not connected to a facility providing treatment.
SHALL
Is mandatory; may is permissive.
SIGNIFICANT USER
Any nondomestic user of the control authority's wastewater
collection system who:
(1)
By definition of process is regulated by the national categorical
pretreatment standards under 40 CFR 403.6 and 40 CFR Chapter I, subchapter
N;
(2)
Has a discharge of process wastewater flow of 25,000 gallons
or more per average workday; or
(3)
Contributes a process waste stream which makes up five (5) percent
or more of the average dry-weather hydraulic or organic capacity of
the POTW;
(4)
Any other industrial user designated as significant by the control
authority on the basis that it has a reasonable potential for adversely
affecting the POTW's operation or for violating a pretreatment
standard or requirement;
(5)
Is found by the authority, Pennsylvania Department of Environmental
Protection (PADEP), control authority, or the U.S. Environmental Protection
Agency (EPA) to have significant impact, either singly or in combination
with other contributing significant users on the wastewater collection
system, the quality of sludge, the system's effluent quality
or air emissions generated by the systems, or has the potential for
impact through its discharge and/or spills.
STANDARD INDUSTRIAL CLASSIFICATION (SIC)
A classification pursuant to the Standard Industrial Classification
Manual issued by the Executive Office of the President, Office of
Management and Budget, 1972.
STATE
Commonwealth of Pennsylvania.
STORMWATER
Any flow occurring during or following any form of natural
precipitation and resulting therefrom.
SUSPENDED SOLIDS (SS)
The total suspended matter that floats on the surface or
is suspended in water, wastewater or other liquids, and which is removable
by laboratory filtering.
TOWNSHIP
Plymouth Township, a Home Rule Municipality, 700 Belvoir
Road, Plymouth Meeting, Pennsylvania 19462.
TOXIC POLLUTANT
Any pollutant or combination of pollutants listed as toxic
in regulations promulgated by the administrator of the EPA under the
provision of CWA 307(a) or other acts.
USER
Any person who contributes, causes or permits the contribution
of wastewater into the collection system or POTW, and includes a significant
user.
WASTEWATER
The liquid and water-carried industrial or domestic wastes
from dwellings, commercial buildings, industrial facilities, and institutions,
together with any groundwater, surface water and stormwater that may
be present, whether treated or untreated, which is contributed into
or permitted to enter the POTW.
WATERS OF THE COMMONWEALTH OF PENNSYLVANIA
All streams, lakes, ponds, marshes, watercourses, wells,
springs, reservoirs, aquifers, irrigation systems, drainage systems
and all other bodies or accumulation of water, surface or underground,
natural or artificial, public or private, which are contained with,
flow through or border upon the state or any portion thereof.

(a) Purpose. It is the purpose of this section to provide for the recovery
of costs from users and significant users of the control authority's
wastewater collection system for the implementation of the program
established herein. The applicable charges or fees shall be set forth
in the control authority's schedule of charges and fees.
(b) Charges and fees. The control authority shall adopt a fee schedule,
including but not limited to the following:
(1) Fees for reimbursement of costs of setting up and operating the control
authority's pretreatment program.
(2) Fees for monitoring, inspections and surveillance procedures.
(3) Fees for reviewing accidental discharge procedures and construction.
(4) Fees for permit applications.
(6) Fees for consistent removal by the control authority of pollutants
otherwise subject to federal pretreatment standards.
(7) Other fees the MIPP Coordinator may deem necessary to carry out the
requirements contained herein.
(9) Temporary discharge permit fees.
(10)
Wastewater contribution permit application fees.
(11)
MIPP sampling and surcharge fees.
(12)
Any charges and fees not listed in the control authority's
fee schedule shall be as determined by the control authority.
