The purpose of this chapter is to establish certain areas that
are private property that are open to the public or in which the public
is invited that shall prohibit parking in areas designated as "No
Stopping or Standing" (fire zones).

A. This chapter
is enacted in accordance with N.J.S.A. 40:48-2.46, which does confer
upon the Borough of Edgewater the right to establish “No Stopping
or Standing” (fire lanes), in order to preserve and safeguard
the public health, safety, morals and welfare.
B. In and
on all premises within the Borough of Edgewater whereon there is located
a retail store, shopping center, office building, industrial plant,
research laboratory, school, church, multifamily residential building
or other public or quasi-public structure wherein the public is invited,
there shall be established a fire zone for the purpose of accommodating
fire and other emergency equipment, which zone when designated shall
be paved and designated "fire zone."
C. The location
and size of the fire lanes to be created shall be determined by the
Fire Official of the Borough of Edgewater or, in the case of any application
pending before it, by the Planning Board upon recommendation of the
Fire Official of the Borough of Edgewater. In formulating the size
and location of the fire zone, due consideration shall be given to
the size of the building and location of the structure to be served
to water supplies and existing facilities for the utilization by emergency
equipment, as well as the flammability of the materials used in the
construction of each particular building.

A. Whenever
a determination has been made for the designation of a fire zone as
hereinbefore provided, the Fire Official shall notify the owner of
the property, in writing, by registered or certified mail or by hand
delivering such notice, specifically describing the area designated
as a "No Stopping or Standing" (fire zone), together with a statement
of reasons therefor.
B. The marking
and remarking of fire lanes shall be the responsibility of and shall
be made at the cost and expense of the property owner. The execution
of the work required shall be fully performed within a period of 90
days from the date of mailing by the Fire Official or receipt by the
property owner in the event that such notice is delivered by hand.
C. The areas
designated as "No Stopping or Standing" (fire lanes) shall be so marked
by signs indicating prohibition of parking in conformance with the
current Manual on Uniform Traffic Control Devices for Streets and
Highways.

The property owner shall be required to maintain fire zone designations
in a good state of repair. The designated area shall be redesignated
in each instance where the area in which the zone has been designated
is repaved, sealed or coated in a manner so as to obscure the fire
zone designation, and otherwise at such time as, in the reasonably
exercised judgment of the Fire Official, the designation shall become
obscure; provided, however, that in such latter instance, no such
redesignation shall be required for at least a period of three years
from the date of the former execution of a fire zone designation plan.

A. Except as set forth in Subsection
B, it shall be unlawful for any person to park, stop or stand any motor vehicle or to otherwise place or store material or obstruct the fire zone.
B. The following vehicles shall be permitted to park, stop or stand
in the fire zone:
(1)
Any fire or emergency vehicle that is actively engaged in the
performance of official business.
(2)
School buses that are loading and unloading passengers. These
vehicles must park in their designated area when waiting more than
15 minutes for passengers.

The Fire Official shall have the authority to designate certain
roads and areas as temporary fire lanes during the construction of
a development project, and the owner or person in control of such
development shall be required to post such designated areas as temporary
fire lanes when so directed by the Fire Official.

Violations of the provisions of this chapter shall be punishable as provided in Chapter
1, Article
II, General Penalty.
