The Planning Board is authorized, simultaneously with the approval
of a plat or plats, to modify applicable provisions of the Zoning
Chapter, subject to the approval of the Board of Trustees, pursuant
to and subject to the conditions set forth in the Village Law and
subject to such other conditions as set forth in this article and
such other reasonable conditions as the Board of Trustees may in its
discretion add thereto.

The Board of Trustees, following recommendation of the Planning
Board, may approve plats with lot dimensions below the minimum area
standard normally required in the zoning district, in order to permit desirable flexibility in subdivision
plat planning consistent with the general character of the community
and the general welfare, provided that:
A. Equivalent additional land is set aside as open or recreational space
or portions of the proposed development are designated for lower density
development.
B. The resulting average population density and land coverage shall
not be greater than was permitted in the zone districts shown on the
Zoning Map.
C. There is no change in permitted or special exception uses.
D. Board of Trustees approval shall be simultaneous with final plan
approval and after public hearing preceded by the same public notice
required for the approval of the plat itself.
E. Nothing hereinbefore contained shall be interpreted as allowing attached
housing.
A description of variances granted shall become a part of the
Planning Board resolution approving each final plat.
