In this article, the following terms shall have the meanings indicated:
OWNER
A. 
The registered owner of a motor vehicle or a lessee of a motor vehicle under a lease of six months or more.
B. 
"Owner" does not include:
(1) 
A motor vehicle rental or leasing company; or
(2) 
The holder of a special registration plate issued under Title 13, Subtitle 9, Part III of the Annotated Code of Maryland Transportation Article.
RECORDED IMAGE
An image recorded by a school bus camera monitoring system:
A. 
On:
(1) 
Two or more photographs;
(2) 
Two or more microphotographs;
(3) 
Two or more electronic images;
(4) 
Videotape; or
(5) 
Any other medium; and
B. 
Showing:
(1) 
The rear of a motor vehicle; and
(2) 
On at least one image or portion of tape, a clear and legible identification of the registration plate number from the front or rear of the motor vehicle.
SCHOOL BUS MONITORING CAMERA
A camera placed on a school bus that is designed to capture a recorded image of a driver of a motor vehicle committing a violation.
VIOLATION
A violation of § 21-706 of the Maryland Code Transportation Article.
A. 
The Office of the Sheriff, in consultation with the County Board of Education, may place school bus monitoring cameras on County school buses to capture a recorded image of a driver of a motor vehicle committing a violation of § 21-706 of the Maryland Code Transportation Article.
B. 
The Office of the Sheriff is authorized to issue citations to vehicle owners based upon the information recorded by the "recorded image" of the school bus monitoring camera in accordance with the Annotated Code of Maryland, Transportation Article, § 21-706.1.
C. 
Should the District Court approve administrative or late fees, the County will assess such fees in accordance with the guidelines established by the District Court.
D. 
If after 35 days the citation has not been satisfied, the County may request adjudication of the case through the District Court.
It is the intent of this article to implement and exercise the use of school bus monitoring cameras as authorized by the Annotated Code of Maryland, Transportation Article, § 21-706.1. Accordingly, the provisions of this article are additional to and not a substitution for any and all of the provisions of Subtitle 7 of Title 21 of the Transportation Article which are hereby incorporated herein by reference. In the event any conflict between the provisions of this article and the incorporated provisions of Subtitle 7 of Title 21 of the Transportation Article, the provisions of Subtitle 7 of Title 21 of the Transportation Article shall control.
