In order to provide economical and efficient control of the
day-to-day administrative activities of the Village of Chittenango,
to maximize the capabilities of Village employees, to reduce the instances
of delays which occur when directions for tasks have to be coordinated
between two or more people, or when functions cannot be accomplished
due to the absence of either the Clerk or the Treasurer, it is deemed
necessary that the positions of Clerk and Treasurer be consolidated
by the creation of the office of Clerk-Treasurer. Further, to avoid
disruption of Village business during periods of temporary absences
or temporary disability of the Village Clerk-Treasurer, the position
of Deputy Clerk-Treasurer is hereby deemed necessary and appropriate.
This chapter is enacted pursuant to the authority granted in
§ 10(1)(ii)(a) of the Municipal Home Rule Law (MHRL) and
§ 4-412(a) of the Village Law (VL). Section 10(1)(ii)(a)
of the MHRL grants authority to the Board of Trustees to pass local
laws to establish or abolish officers, boards and committees. Section
4-412(a) of the VL grants the Board of Trustees authority to control
local governmental administration, as well as to establish or abolish
offices of a village.
Pursuant to Municipal Home Rule Law § 10 and Village
Law § 4-412, and upon a determination that the best interests
of the Village would be served thereby, the office of Clerk-Treasurer
is hereby created.
The separate offices of Village Clerk and Village Treasurer
are hereby abolished. All powers, duties and responsibilities set
forth in the Village Law for the former Village Clerk and Village
Treasurer are consolidated in the office of Village Clerk-Treasurer.
Pursuant to Municipal Home Rule Law § 10 and Village
Law § 4-412, and upon a determination that the best interests
of the Village would be served thereby, the position of Deputy Clerk-Treasurer
is hereby created.
The Village Clerk-Treasurer shall be appointed by the Mayor,
subject to approval by the Board of Trustees. A Village Clerk-Treasurer
shall serve a term of four years, to coincide with the term of the
Mayor, during whose term the Clerk-Treasurer is appointed. The Board
of Trustees shall fix the compensation, hours of work and work conditions
of the Clerk-Treasurer.
The Village Deputy Clerk-Treasurer shall be appointed by the
Mayor, subject to approval by the Board of Trustees. The Deputy Clerk-Treasurer
shall serve a term of four years, to coincide with the term of the
Mayor, during whose terms the Deputy Clerk-Treasurer is appointed.
The compensation, work hours and work conditions of the Deputy Clerk-Treasurer
shall be fixed annually by the Board of Trustees.

Each person designated as Clerk-Treasurer and Deputy Clerk-Treasurer
need not be a legal resident or elector of the Village of Chittenango,
provided, however, that such person(s) shall reside in the County
of Madison. The positions shall be exempt, unclassified and noncompetitive.
In the case of vacancy in these offices, and upon direction to fill
the vacancy by the Board of Trustees, the Mayor shall appoint a qualified
person to fulfill the remaining term of the Clerk-Treasurer or Deputy
Clerk-Treasurer.
The Village Clerk-Treasurer shall report to, and be under the
supervision of, the Mayor and shall be ultimately responsible to the
Board of Trustees. The Clerk-Treasurer shall have the combined powers
and responsibilities set forth in Village Law § 4-402 for
the "Clerk" and set forth in Village Law § 4-408 for the
"Treasurer."
During the temporary absence or disability of the Village Clerk-Treasurer,
the Deputy Clerk-Treasurer shall have the temporary authority, responsibility
and accountability of the office of Village Clerk-Treasurer, to act
during the period of the absence or disability of the Clerk-Treasurer.
At all other times, the Deputy Clerk-Treasurer shall perform such
tasks as designated by the Clerk-Treasurer, the Mayor and/or the Board
of Trustees.
