This Chapter consists of the rules and regulations for the operation of the Police Department of this City. To the extent that this Chapter conflicts with the provisions of Chapter
120 (relating to personnel), this Chapter shall prevail. To the extent that regulations promulgated by the Mayor or by the Chief of Police, under the authority of this Chapter, conflict with the provisions of Chapter
120 (relating to personnel), then Chapter
120 shall prevail.

The Chief of Police is the director of the Police Department.
He/she shall have immediate and direct control of the department,
subject to the supervision of the Mayor, and subject to such other
rules, regulations and orders as the Mayor may prescribe. He/she shall
promulgate and enforce orders, rules and regulations (consistent with
this Code and with the rules, regulations and orders of the Mayor)
for the efficient operation of the Police Department.

Assignment of a Patrolman is at the discretion of the Chief
of Police. For the purpose of this Chapter, all Police (including
the Chief) are considered Patrolmen.

A. Every member of the department shall wear the uniform as the Board
of Aldermen may from time to time prescribe. Every member of the department
shall, when on duty, carry such equipment as the Chief of Police may
prescribe or adopt and, when in uniform, keep his/her badge always
in sight. No member of the department shall ever appear for duty in
civilian clothing without special permission by the Chief of Police
and approval by the Mayor of the City of Canton, Missouri.

At the time a Police Officer is hired by the City of Canton,
Missouri, the City shall pay for and shall issue to the Police Officer
the following Class A uniform:
a.
Two (2) summer shirts with patches;
b.
Two (2) winter shirts with patches;
c.
Two (2) pairs of trousers;
f.
One (1) pair of suitable law enforcement footwear to match the
Class A uniform;
g.
One (1) pair of rain pants.
h.
One (1) custom-fitted bulletproof vest.

2.
Upon the anniversary date of the hiring of a full-time Canton, Missouri, Police Officer, the Officer shall be provided with an annual issue of a replacement uniform, at the Officer's choice, of either of the articles from a Class A uniform listed in Subsection
(A)1 or
a Class B uniform which shall include the following:
a.
One (1) pair of BDU pants;
b.
One (1) long-sleeve or short-sleeve polo shirt and badge clip
with badge visible.
3.
Each Police Officer must have two (2) complete and serviceable
Class A uniforms as described herein before a Class B uniform will
be issued.
4.
For any Police Officer who discontinues employment before being
employed sixteen (16) months, the payback schedule for the uniform
is as follows:
a.
Zero (0) to four months: Payback of 100%;
b.
Four (4) to eight (8) months: Payback of 75%;
c.
Eight (8) to twelve (12) months: Payback of 50%;
d.
Twelve (12) to sixteen (16) months: 25% payback;
e.
Sixteen (16) months or longer: no payback required.
5.
The amount due from the employee for reimbursement for uniform costs as provided for in Subsection
(A)(4) above shall be deducted from any wages or other compensation to be paid to the employee following the end of employment.

6.
If there is insufficient remaining wages or other compensation
to reimburse the City for the reimbursement of uniform costs, the
terminating employee shall still be liable to the City for the reimbursement
due to the City for the uniform costs.

No member of the department shall wear his/her uniform or carry
a pistol while under suspension for any cause, and such member shall
immediately surrender his/her badge and Police identification to the
Chief of Police when notified of his/her suspension.

Although regular hours of duty shall be assigned to all members
of the department, it shall be the duty of every officer of the department,
at all times, day or night, within the City, to preserve the public
peace, protect the rights of persons and property, guard the public
health, preserve order at all elections and public assemblies, prevent
and remove, if possible, nuisances on and in all streets, highways,
areas, alleys and other places, and enforce the criminal laws of the
State of Missouri and the ordinances of the City.

No officer shall willfully mistreat or use unnecessary violence
toward any person, prisoner or otherwise. He/she shall not strike
any prisoner except as a last resort in an effort to overcome resistance
or prevent escape. An officer shall not shoot at a fleeing person
or any escaping prisoner unless he/she has probable cause to believe
that such person has committed a felony.

All full-time Police Officers employed by the City shall be
between the ages of twenty-one (21) years of age and sixty-five (65)
years of age. They shall be of good moral character and shall not
have been convicted of any felony. They shall be able to write legibly
and shall furnish at least three (3) good character references. A
written examination for any applicant for Police Officer for the City
shall be discretionary with the Board of Aldermen. Any of these qualifications
may be waived by the Board of Aldermen by resolution. All Police Officers
shall meet the minimum standards as established from time to time
and be qualified under Chapter 590, RSMo.

A. The
City of Canton, Missouri, shall participate in the formation of a
major case squad with other governmental units located in Adair, Chariton,
Clark, Knox, Lewis, Macon, Marion, Monroe, Ralls, Randolph, Schuyler,
Scotland, Shelby and Pike Counties to be known and designated as the
"North East Missouri Major Case Squad".
B. The
Chief of Police of the City of Canton, Missouri, be and is hereby
authorized and directed on behalf of the City of Canton to execute
any and all documents necessary in order to form and participate in
such major case squad pursuant to Section 70.835, RSMo.

A. All Peace Officers employed by the City of Canton, Missouri, before
being hired must have completed all of the requirements of the Peace
Officers Standards and Training Program (POST) as specified in Chapter
590, RSMo.
B. Once a Peace Officer has been hired by the City as a full-time employee
of the Canton Police Department, the officer will be able to make
application to qualify for assistance to the officer in payment of
all or part of the cost of POST certification.
C. In consideration of receiving compensation for all or part of the
cost of POST certification, the officer must agree to serve as a Police
Officer for the City of Canton, Missouri, for a period of not less
than forty-two (42) months after the officer's employment date as
a POST Officer.
D. The first six (6) months of the employment as a Police Officer will
be probationary and will have to be successfully completed by the
Missouri POST Officer. No POST cost reimbursement will occur until
the six-month probationary period is successfully completed.
E. Once the six-month probationary period is successfully completed,
the Peace Officer may receive reimbursement for POST costs. For every
month that the officer shall leave employment by the City of Canton
as a Police Officer following the six-month probationary period and
prior to serving as a Police Officer for thirty-six (36) months after
the employment date, the officer will reimburse the City on the basis
of one-thirty-sixth (1/36) per month for the officer's pro-rata share
of all costs and expenses advanced by the City for POST training.
F. The maximum training costs reimbursement that will be paid by the
City shall be the lesser of:
1.
Five thousand four hundred seventy dollars ($5,470.00).
2.
The actual cost of training of the Missouri POST Officer based
on the documentation of costs provided by the Missouri POST Officer
to the City in a form acceptable to the Mayor of the City.
G. If a Police Officer shall cease to be employed by the City prior
to completing forty-two (42) months of service to the City as an officer,
the City may retain and deduct amounts due for reimbursement by the
officer from any amount due to the former officer in wages at the
time employment ceases. The Police Officer will continue to be liable
for all reimbursable POST costs not paid by the deduction from wages
at the time employment ceases.
H. If the Police Officer who has received POST reimbursement shall become
deceased or permanently and totally disabled as defined under Missouri
State Law while in the employment of the City, the total training
expense reimbursement obligation shall be deemed satisfied in full.

A. All Peace Officers employed by the City of Canton, Missouri, before
being hired must have completed all of the requirements of the Peace
Officers Standards and Training Program (POST) as specified in Chapter
590, RSMo.
B. Prior to being hired as a Peace Officer of the City of Canton, Missouri,
a prospective officer may make application to qualify for payment
of the POST Program costs and become a probationary employee of the
City of Canton (this program to be referred to herein as the "POST
Training Program").
C. To qualify for the POST Training Program, all applicants must complete
the following requirements:
1.
Drug screen and medical examination to determine physical ability
to perform the duties of a Police Officer.
2.
A background check performed by the City of Canton.
3.
Provide the City of Canton with a copy of the applicant's
social security card and driver's license.
D. Employment under the POST Training Program is specifically conditioned upon the completion, to the satisfaction of the City of Canton at its sole and unreviewable discretion, of all of the requirements of Subsection
(C).
E. If a prospective Peace Officer is accepted for the POST Training
Program, the City of Canton will advance money for the prospective
officer's tuition at the appropriate academy to pay for the cost
of the POST training.
F. Upon qualifying for the POST Training Program, the City will hire
the person qualifying for the program as a probationary employee of
the City of Canton. As a probationary employee, the person participating
in the POST Training Program shall be entitled to compensation at
the rate of $18.14 per hour, not to exceed a 40 hour week, together
with all employee benefits provided by the City of Canton, Missouri,
to probationary employees.
G. In consideration of receiving compensation for the POST Training
Program, and being hired as a probationary employee of the City of
Canton during the training period, the person employed as a Police
Officer upon the completion of the POST training must agree to serve
as a Police Officer for the City of Canton, Missouri, for a period
of not less than 42 months after the officer's employment date
as a regular POST qualified Police Officer.
H. The person who has received the POST officer's training shall
continue as a probationary employee of the City of Canton until the
completion of the probationary employment period of six months. If
the person hired under this program shall fail to complete the probationary
employment period, the person shall be required to reimburse the City
of Canton for the entire cost expended by the City of Canton for the
POST Officer Training Program.
I. The training costs reimbursement that will be paid by the City of
Canton shall be:
1.
The actual cost of the training of the Missouri POST officer
based on the documentation of costs provided by the Missouri POST
officer to the City of Canton in a form acceptable to the Mayor of
the City.
2.
The cost of ammunition that the prospective employee will be
required to provide to complete the POST training.
J. If a Police Officer shall cease to be employed by the City of Canton
prior to the completion of the 42 months of service to the City of
Canton as an officer, the following shall apply:
1.
The Police Officer shall be liable to repay to the City of Canton a pro rata portion of the amounts paid by the City of Canton under the POST Training Program based on how many months of service requirement that has been performed by the Police Officer, except as provided in Subsection
(J)(2).
2.
If the Police Officer shall fail to perform all 42 months of
the service requirement to become a Police Officer for any other law
enforcement entity, regardless of where located, the entire amount
paid under the POST Training Program shall be immediately due and
payable by the Police Officer to the City of Canton.
3.
Any amounts due to the City by reason of failure to complete
the 42 month service requirement may be deducted by the City of Canton
from any amount due to the former officer in wages at the time employment
ceases.
4.
If the Police Officer who has received payments under the POST
Training Program shall become deceased or permanently and totally
disabled as defined under Missouri State Law while in the employment
of the City of Canton, none of the costs of the POST Training Program
shall be reimbursed, and the cost of the POST Training Program shall
be deemed satisfied in full.
5.
The Police Officer will also be responsible to pay the City
of Canton for any City-issued equipment damaged, lost, or destroyed
by the Police Officer during the POST training period.
