There is hereby established the Economic Development Commission of the City of Olivette, which shall possess all of the powers and be subject to all of the responsibilities imposed upon it by law, the ordinances of the City and the directions of Council.

A. 
The Commission shall be composed of five (5) voting members.
B. 
The City Council shall appoint three (3) voting members who shall be residents of the City and two (2) voting members who shall be representatives of businesses located in the City. Expertise relevant to the performance of the Commission's responsibilities, which may include, but not be limited to, knowledge or experience in commercial real estate, economic development, marketing or investment banking shall be a factor considered in making such appointments. If the Council is unable to appoint at least two (2) qualified local business representatives who are able and willing to serve, the Council may appoint one (1) or more residents in lieu thereof. Voting members shall serve for a term of three (3) years, but initial voting members shall be appointed to staggered terms.
C. 
Each member of the Commission shall serve until a successor is appointed and qualified.

A. 
The Commission shall elect from among its membership a Chair, a Vice Chair and a Secretary, each of whom shall serve for a one (1) year term and may be re-elected.
B. 
The Commission shall abide by Missouri's Open Meetings and Records Act, Sections 610.010, RSMo., et seq., as may be amended from time to time. No action shall be taken or recommendation made by the Commission to the Council except by a vote of at least four (4) of its members. The Commission shall otherwise abide by the procedures established in Scott Foresman newly revised Robert's Rules of Order, except as otherwise may be provided by law.

A. 
The Commission shall make recommendations to the City Council and staff regarding policies, regulations, marketing, development strategies and activities to retain and enhance the economic base of the City and articulate a vision of economic development with clearly defined goals and objectives for the City during a rolling five (5) year horizon.
B. 
The Commission shall make recommendations for the economic development of the City pursuant to the City's strategic plan, the progressive pursuit of establishing new business in the City with the intent of creating jobs and employment opportunities and the recommendation of appropriate development incentives to insure projects that come to the City are economically viable.
C. 
The Commission shall also:
1. 
Conduct such studies as are necessary to gather information within the area of economic development in accordance with the adopted strategic plan of the City;
2. 
Review and recommend areas for economic development within the City and the types of development proposed for these areas in accordance with the strategic plan of the City;
3. 
Conduct a comprehensive review of the financial alternatives which are available and feasible for the City to use to encourage economic growth including, but not limited to, industrial revenue bonds, community development block grant funds, Federal economic development programs, tax incremental financing, commercial development bonds and other economic development tools authorized under State law;
4. 
Study both long-term and short-term activities to be recommended to the City Council;
5. 
Review and make recommendations to the appropriate Governing Body of the City regarding the use and administration of any and all economic development incentives available to, or utilized by, the City for its economic needs and development;
6. 
Prepare an annual Commission budget of projected revenues and expenditures for approval by the City Council;
7. 
Market the City of Olivette to regional and national investors and cooperate with the Creve Coeur-Olivette Chamber of Commerce for such marketing efforts; and
8. 
Review the Olivette strategic plan as may be necessary or desirable and recommend to the City Council and the Planning and Community Design Commission such plan amendments deemed by the Commission to be reasonable and necessary for the City's ongoing economic development.
9. 
If allowed by law and elected or appointed by the relevant governing authority in accord with applicable law, the Commission or its members may serve as the board of directors, board of commissioners or development authority or as members thereof for the City of Olivette under Missouri's economic development Statutes and exercise such authority granted under said Statutes, which shall include, but not limited to:
a. 
Chapter 349, RSMo., Industrial Development Corporation Act;
b. 
Chapter 353, RSMo., Urban Redevelopment Corporation Act;
c. 
Section 99.800, RSMo., Real Property Tax Increment Allocation Redevelopment Act;
d. 
Section 67.1401, RSMo., Community Improvement District Act;
e. 
Section 238.200, RSMo., Missouri Transportation Development District Act;
f. 
Section 99.300, RSMo., Land Clearance for Redevelopment Authority Act; and
g. 
Section 100.010, RSMo., Industrial Development Project Act.
