The purpose of this ordinance is to protect the health, safety
and welfare of the general public pursuant to N.J.S.A. 40:48-2 by
prohibiting smoking in certain areas of the Township.
As used in this chapter, the following terms shall have the
meanings indicated:
MUNICIPALLY OWNED FACILITIES
All public buildings owned or leased or rented by the Township
of Lacey upon which the public is invited or upon which the public
is permitted and where individuals gather, including all adjacent
facilities, including but not limited to any parking area, driveway
or lane. The facilities shall include the Municipal Building Complex
located at 818 Lacey Road, consisting of the Municipal Building (also
known as Block 1837, lot 5) and the adjacent grounds, parking area,
driveways and lanes; the Police Department (also known as Block 1837,
lot 5) and the adjacent grounds, parking area, driveways and lanes;
the Recreation Department (also known as Block 1837, lot 5) and the
adjacent grounds, parking area, driveways and lanes; the Public Works
Facility and Recycling Center (also known as Block 1837, lot 5) and
the adjacent grounds, parking area, driveways and lanes; the Community
Hall and Worden House (also known as Block 284, lot 1.01) and the
adjacent grounds, parking area, driveways and lanes; the Food Bank
Complex (also known as Block 275, lots 1, 2, 3, 4 and 15) and the
adjacent grounds, parking area, driveways and lanes; the Schoolhouse
Museum (also known as Block 276, lot 18) and the adjacent grounds,
parking area, driveways and lanes; and the Lacey MUA Offices (also
known as Block 276, lots 13, 14, 15) and the adjacent grounds, parking
area, driveways and lanes.
SMOKING
The burning of, inhaling from, exhaling the smoke from, or
the possession of a lighted cigar, cigarette, pipe or any other matter
or substance which contains tobacco or any other matter that can be
smoked or the inhaling or exhaling of smoke or vapor from an electronic
smoking device.
This chapter shall be enforced by the Police Department or Code
Enforcement Officer of the Township of Lacey.
Any person who is found to be in violation of the provisions
of this chapter shall be subject to a fine not to exceed $1,000 and/or
community service of not more than 90 days, and/or by a term of imprisonment
not to exceed 90 days or any combination of fine, community service
and imprisonment, as determined in the discretion of the Municipal
Court Judge.
