A. The City
of Ellisville, Missouri, hereby contracts and agrees to cooperate
with the City of St. Louis, Missouri, St. Louis County, Missouri,
and that each and every City, Town and Village within St. Louis County,
Missouri, for certain common Police services under the terms and conditions
hereinafter set forth. This contract shall become effective with respect
to each such municipality or County upon the passage of a like ordinance
by the legislative body of such municipality or County authorizing
such contract by such municipality or County.
B. The consideration
for this contract shall be the mutual agreements of the parties hereto
for the services to be given for the protection of lives and property
by the Police Department of each participating municipality or County
and no compensation shall occur to be paid by any participating municipality
or County to any other.
C. This
contract, insofar as it is applicable to any particular municipality,
may be terminated at any time by any party hereto thirty (30) days
after service upon the Clerk of each remaining contracting municipality
or County of a certified copy of any ordinance terminating the agreement
of such municipality or County.

The members of the Police force of the City of Ellisville shall
respond, if consistent with the public safety of the City of Ellisville,
to request for assistance within the boundary limits of any other
contracting municipality or County pursuant to the directions and
regulations provided by the office of the Chief of Police of the City
of Ellisville.

It shall be the duty of the members of the Police force of the
City of Ellisville to perform Police services in any contracting municipality
or County when requested by such municipality or County and authorized
to do so by the office of the Chief of Police of the City of Ellisville.

Each Ellisville Police Officer performing services in any other
municipality or County in accordance with the terms of this contract
shall have all of the power, rights, privileges, duties and immunities
as the members of the Police Department of the municipality or County
requesting assistance, but shall remain in the employment and under
the direction, supervision and control of the office of the Chief
of Police of the City of Ellisville, Missouri.

A. Equipment
and property utilized in carrying out the common Police service provided
by the agreement shall be at the risk of the municipality or County
owning same and any loss or damage thereto shall be born by such owner
municipality or County; provided that nothing herein contained shall
be construed to limit the liability of any municipality or County
or its agents, servants or employees arising out of tortious conduct.
B. No municipality
or County participating in this agreement shall be liable to any other
for failure to respond to any call by the owners or for delay or negligence
or mistake in receiving or responding to any call, nor shall this
agreement be interpreted as being an agreement for the benefit of
any third (3rd) person.
C. Nothing
herein contained shall be construed to mean that a Police Officer
of any municipality or County participating in this agreement who
is injured, killed or who dies of injuries sustained while performing
services in the City of Ellisville under this agreement shall be covered
by any insurance provided by the City of Ellisville for its Police
Officers.
D. No Police
Officer of the City of Ellisville otherwise entitled to the benefits
and protection of any insurance carried by the City of Ellisville
shall be deprived thereof by reason of the fact that such officer
was injured, killed or death occurred as a result of injuries sustained
in another municipality or County, provided that any such injury or
death occurred while such officer was performing services pursuant
to this agreement.

A. The Police
Department is authorized to cooperate with such law enforcement agencies
in the St. Louis metropolitan area as are members of the St. Louis
Metropolitan Major Case squad formed in or about 1965 and made up
of specially trained Law Enforcement Officers from law enforcement
agencies in the St. Louis metropolitan area for the purpose of providing
investigative resources to its member law enforcement agencies where
necessary to effect an expedient solution to more serious crimes,
including murder, aggravated assault, robbery, rape, burglary or other
crimes of a magnitude to constitute a community threat, for the purpose
of providing assistance in the intensive professional investigation
of such crimes under such circumstances and subject to such guidelines
as are designated by the St. Louis Metropolitan Major Case Squad,
subject to the provisions of Section 70.835, RSMo., 1986 and provided
that the Governing Body of the particular political subdivision where
the crime under investigation occurred as by order, in the case of
a County or by ordinance in the case of a City, entered into such
a cooperative agreement with the St. Louis Metropolitan Major Case
Squad.
B. The City
members of the St. Louis Metropolitan Major Case Squad shall be designated
by the Chief of Police and may be removed by him/her at any time.
At no time shall the Chief of Police allow the operations of the St.
Louis Metropolitan Major Case Squad to leave the City with inadequate
Police protection.
C. No member
of the St. Louis Metropolitan Major Case Squad shall be considered
an employee of the City for any purpose, unless they are members of
the regular City of Ellisville Police Department.
